Nonsense. A civil penalty is a penalty for violating a civil law. That's still a crime. It's just a violation of a civil law instead of a criminal law.

Cohen plead guilty to a federal crime which he said he paid the money out of his own pocket then went back after the fact and aaid he executed the NDA and wanted paid for his legal services
