Who would have thought that Louisiana's senate election (now due to a run-off next month) would be so damn important.......As it currently stands, the GOP has 51 senate seats to Dems. 48, and the run-off may either make the count 52-48 or 51-49.
This run-off is important because of the possible filibusters that Dems would apply when fighting off the GOP's wishes to also control the SCOTUS.
Bear in mind that the SCOTUS status will impact on the upholding of Roe v. Wade and the continuation of Dodd-Frank...the only safeguard toward another WS banks' possible claim that they're too big to fail.
The only thing that would happen if Roe was overturned is that there would be Restrictions on Abortion in places that wanted restrictions, it would be protected in places where people don't want restrictions, and maybe the country could stop wasting time on it.
The Court expected a Clauswitzian victory on the topic when it decided Roe, instead if got 40 years of the same fight being fought again and again and again.
If some states were to opt out from Roe, there will be a flooding into abortion clinics from states like Alabama to Washington or California. If this restriction on women is thought to be an "asset" for conservatives, there will be adverse repercussions instead.
It's not an asset, it's what has to happen if you believe in Strict Construction of the Constitution. I would never vote to ban abortion outright, or even all of these petty ante attempt to suppress it within the framework of Roe.
What I don't see is any constitutional standing for it. Roe has put the debate on Abortion into a 40 year freeze cycle. Overturning it and letting the States figure it out is the only way to achieve if not a Clauswitzian resolution, then at least a State based state of Detente.
