Which would end up in Biden's removal from office, not a criminal proceeding. If DOJ found he did violate US Statutes, they could criminally prosecute Biden after he was removed from office.

The US Constitution (and it's amendments) use the word "SHALL" 306 times.
In each case, it's a mandatory command. Including....

the party convicted shall nevertheless be liable and subject to indictment, trial, judgment and punishment, according to law.

No different than the first uses of "shall" in the Constitution

It was the National Archives who took Obamas presidential papers, and stored them in a Chicago warehouse. The National Archives later looked through their warehouse and found classified documents, that they transferred into a secure area within the warehouse.

So documents that NARA sent, gotcha.
