Not at all. She got shot because she presented an immediate threat by coming through the window.

There was nothing between her and the officers anymore. They broke the doors to come through. That was the last line of defense. The threat then became immediate.

She was not an immediate threat hanging halfway through a window yards away from the firing officer.

No, the context was a never before scene where a mob violently broke into the Capitol to stop the certification. Police were vastly outnumbered yet remained diligent to protect the lives of lawmakers & staff. It was insanely chaotic and that mob was violently breaking down the last barricaded door leading to members of Congress and staff.

There were only two officers in position to shoot. Byrd and another officer further down in the Speaker's Lobby. The other officer didn't have a clear shot because from his angle, he could have it someone else had he missed. Byrd was the only officer there with a clear shot and the perfect angle.
