Qanon shaman...likely to get a new trial considering the government withheld video evidence from the defense....

The Cap Police are part of Govt, they aren't allowed to illegally withhold Brady evidence....they aren't above the law.

You have yet to show the DoJ was in possession of these videos when BuffaloHead pleaded guilty AND you have yet to show these videos are covered by Brady.

LOLOLOL

You claimed the DoJ said they didn't turn over these videos to the defense.

When challenged on that, you THEN post a link to an article which says the DoJ DIDN'T say they turned those videos over to the DoJ

Kimberly Paschall, the assistant U.S. attorney for the District of Columbia who Watkins said lied, did not immediately return a request for comment. A spokesman for her boss, U.S. Attorney for the District of Columbia Matthew Graves, declined to comment even though Chansley’s case is not ongoing.

Did you even bother to read that article? Or did you simply not understand it?

You're such a flamin' idiot. :lmao:
What in that article makes you think the DOJ turned everything over?

The DOJ is charged with having them.https://www.law.cornell.edu/wex/brady_rule

The Brady rule, named after Brady v. Maryland, requires prosecutors to disclose material, exculpatory information in the government's possession to the defense. Brady material, or the evidence the prosecutor is required to disclose under this rule, includes any information favorable to the accused which may reduce a defendant's potential sentence, go against the credibility of an unfavorable witness, or otherwise allow a jury to infer against the defendant’s guilt.

Initially, the Brady rule was only applicable if the defendant made a pretrial request for specific information which the prosecution denied. In United States v. Bagley, however, the Supreme Court eliminated this request requirement and stated that the prosecution has a constitutional duty to disclose all material, favorable information in their possession to defendants regardless of whether it is requested. This duty is breached regardless of whether that information is withheld intentionally or unintentionally.

Not being privvy to the defense, I have no idea what was or was not turned over.

That has nothing to do with you lying, claiming the DoJ said they didn't turn over these videos.

of course we know they didn’t…the defense has said they didn’t

so? going to trial has nothing to do with Brady evidence and the Govt burden to turn it over
It does. The government is required to turn it over before trial.

It never went to trial. He took a plea.

Therefore it didn’t affect his defense because there was no defense.

yes…read the link that was provided in the OP they discussed it
So all you have is a one sided allegation from a criminal defense attorney that you did no fact checking for.

Is that right?
