A drug abuse counselor who drove drunk and struck a pedestrian — then drove around with the dying man on her windshield — bawled her eyes out in court as she was sentenced to 55 years to life in prison on Thursday.
A teary-eyed Sherri Lynn Wilkins, 53, was convicted of second-degree murder, drunken driving and a hit-and-run — after killing Phillip Moreno in an LA suburb in 2012.

After plowing into him, Wilkins drove for two miles with Moreno on her windshield, until other motorists swarmed her car at a traffic light and called the cops, prosecutors said.
Her blood-alcohol level was nearly twice the legal limit.

Wilkins was a former heroin abuser before she became a drug counselor. She claimed she was “self-medicating” while waiting for knee replacement on the night of the hit-and-run.
During the trial, she testified she had been drinking that night but wasn’t drunk. She claimed she never saw Moreno coming.

Why is this good news? Someone is dead. Another is spending the rest of her life in prison. This is a tragedy. While judge has to be done that doesn't mean the fact that we need justice to be done is a good thing.

Those who are convicted of first degree murder get more severe sentences than those who commit second degree murder. First degree convictions result in life sentences, with or without the possibility of parole and in certain states can result in the death penalty. The laws vary from state to state, but here are the penalties for First and Second Degree Murder degree murder in my home state of Florida:

The crime of First Degree Murder is designated a Capital Offense and only has two possible sentences:

* Death, or

* Life without the possibility of parole.

If convicted of Second Degree Murder, a judge is required to impose a minimum prison sentence of 16¾ years in prison and can impose any additional combination of the following penalties:

* Up to Life in prison.

* Up to Life on probation.

Under Florida's 10-20-Life law, a person who uses a Firearm to commit Second Degree Murder must be sentenced to a minimum-mandatory prison sentence of 25 years.
