The State of Palestine

Decisions of international and national tribunals

The U.S. State Department Digest of International Law says that the terms of the Treaty of Lausanne provided for the application of the principles of state succession to the "A" Mandates. The Treaty of Versailles (1920) provisionally recognized the former Ottoman communities as independent nations. It also required Germany to recognize the disposition of the former Ottoman territories and to recognize the new states laid down within their boundaries. The Treaty of Lausanne required the newly created states that acquired the territory to pay annuities on the Ottoman public debt, and to assume responsibility for the administration of concessions that had been granted by the Ottomans. A dispute regarding the status of the territories was settled by an Arbitrator appointed by the Council of the League of Nations. It was decided that Palestine and Transjordan were newly created states according to the terms of the applicable post-war treaties. In its Judgment No. 5, The Mavrommatis Palestine Concessions, the Permanent Court of International Justice also decided that Palestine was responsible as the successor state for concessions granted by Ottoman authorities. The Courts of Palestine and Great Britain decided that title to the properties shown on the Ottoman Civil list had been ceded to the government of Palestine as an allied successor state.[16]

Opinions of officials and legal scholars

For John Quigley Palestine's existence as a state predates the 1988 declaration. Tracing Palestine's status as an international entity back to the collapse of the Ottoman Empire after World War I, he recalls that the Palestine Mandate (1918–1948), an arrangement made under Article 22 of the Covenant of the League of Nations, held as its "ultimate objective", the "self-determination and independence of the people concerned." He says that in explicitly referring to the Covenant, the 1988 declaration was reaffirming an existing Palestinian statehood.[126] Noting that Palestine under the Mandate entered into bilateral treaties, including one with Great Britain, the Mandatory power, he cites this as an example of its "sovereignty" at that time. He also notes the corollary of the Stimson Doctrine and the customary prohibition on the use of force contained in the Restatement of Foreign Relations Law of the United States, "[a]n entity does not necessarily cease to be a state even if all of its territory has been occupied by a foreign power".[86]

States recognising the State of Palestine

The exact number of countries recognizing the State of Palestine is unknown, due to the equivocal nature of many official statements of acknowledgment.[155] Many countries have a standing policy against making formal declarations that recognize new governments instead indicating their recognition of a state by doing business with its government.[105] Francis Boyle, legal advisor to the PLO, assisted the organization in drafting the 1988 Declaration of the Establishment of the State of Palestine. At that time, the United States was using its Foreign Assistance Act and other measures to discourage other countries and international organizations from extending recognition.[156] According to one author, by 1988, more than 100 countries had recognized Palestine.[157] Boyle reported in 1990 that the number was 114 states.[95] In 2005, Anat Kurz reported that 117 United Nations member states had formally recognised the state of Palestine as a sovereign state.[158] In 2010, Boyle reported that the number was 127.[159]

Can you show us where "Palestine" appears in the Quran?

David Ben Gurion, future Prime Minister of Israel, 1937, Ben Gurion and the Palestine Arabs, Oxford University Press, 1985: "We must expel Arabs and take their places."

Big deal, all this proves is they were Arabs, not Palestinians.

Ben Gurion is not Israel.

That fabricated Ben Guriuon "quote" was debunked long ago. In fact, he wrote the complete opposite, that we must NOT expel Arabs.

The low level of education here is truly embarrassing.

Wikipedia, tough source.

Treaty of Lausanne, is not described correctly by wikipedia, or whatever you posted.

The Treaty of Lausanne, 1912. Brought to an end the Turco-Ialian war. This is how the treaty is described. Accurately, and as "The Near East, A Modern History", by William Yale 1958 describes the treaty (one of my sources).

A treaty that is not negotiated by the people is not a treaty for the people. No people from the Ottoman controlled Syria are present during the negotiation nor signing of The Treaty of Lausanne.

If this treaty is of importance here is a link to the treaty, feel free to read it, quote the treaty, and make your point, I should not have to read wiki, my books, the treaty, to discover what specific section wiki is making a point about.

The treaty had no bearing on the Jews return to Israel. If the treaty does please site where.

So your position is; that there is ample proof of a government established in former Ottoman, former Syrian territory and that government is Arab. Born in Palestine. As mandated, and administered by the United Kingdom or whoever Britain called itself in 1920 give or take a few years.

Books can be vague, I agree the British were busy, I know the Zionist were busy, Zionist do not make a country. Not to be critical of anything you post, but a question I ask is how come its so hard to learn about the structure of the society, the culture, the government, in Palestine and did the government being formed have shape and purpose defined by a document, something such as a declaration of independence, or a Constitution.

Culture and tradition of Arab people say no.

As far as I can tell as I read, Tribes of Bedouin ruled the deserts, the oasis, some cities, some families ruled particular cities.

I cannot find, and nobody has ever shown me a unified government of the people in Palestine.

Palestine was never a nation unified and governed of the people of Palestine.

Never in its history.

The right to self determination has been enshrined in international law for over a century. For outsiders or foreigners to determine the fate of a country against the wishes of the inhabitants violates that most basic right.

The general consensus among the permanent resident of Palestine be they Muslims, Christians, or Jews was that Palestine was already their country. The Palestinians including the Jews were opposed to the creation of a Jewish state in Palestine.

In 1948 Palestine declared statehood. In 1988 this deceleration was reiterated. On March 19, 2003 Palestine ratified a new constitution. There was no mention of changing its defined and recognized borders. There was no mention of Israel, the West Bank, or Gaza. There was no mention of the occupation. There was no mention of Oslo or the PLO.

Arabs have nearly 30 countries on 8 million sq miles of landmass.

More than enugh "self determinatin" especially since Arabs have never had any self determination. They're among the most unproductive people in the world

There has never in history been a legal or political entity [state] known as Palestine.

Palestine was invented by the Romans when they renamed Judea, land of the Jews, "Palaestina" however it was nothing more than a Roman province.

During Ottoman rule, Palestine was merely southern Syria, rued by Damascus and at other time by Beirut

Thus, Jews are the only Palestinians.

Palestine's citizens are the permanent inhabitants of Palestine.

Israel has no borders. It has no land it can legally put borders around. Israel sits inside Palestine's borders.

As the UN General Assembly lacks the power to do more than make recommendations, the starting point for Palestinian statehood or independence is not UN General Assembly Resolution 181 which recommended that two states be created on Palestinian territory. Instead it is the right to self-determination that the Palestinian people have as the indigenous people of Palestine. This right is perhaps the most notable human right in the United Nations. It is the only human right expressly recognised in the Charter of the United Nations, where articles 1, 55, and 73 acknowledge it. The right to self-determination is an essential — the most essential for many states — part of customary international law and has been declared one of the most basic principles of customary international law by the UN General Assembly’s Declaration on the Principles of International Law concerning the Friendly Relations and Cooperation among States.

The right to self-determination has been explicitly recognised as applicable to the situation of the Palestinian people by the UN General Assembly for more than 30 years. To this end it established the Committee on the Exercise of the Inalienable Rights of the Palestinian People in 1975 to work towards the realisation of this right. This right provides all peoples, including the Palestinian people, the right to determine their own future. It is a right that Israelis did not enjoy in Palestinian territory when they unilaterally declared their state in violation of Palestinians’ right to self-determination. The Palestinian right to self-determination pre-existed any effort by Israel to occupy Palestinian lands. It is a right that all Palestinians are entitled to exercise according to international law since at least the 1920s. It is thus a right that is enjoyed over all of the territory over which the British Mandate was approved by the League of Nations in 1922.

This does not mean that Palestinians are required to exercise this right, but if they wish to do so they are entitled to do so. They need no permission from anyone else. Indeed, today more than half the states in the international community recognise Palestine as a state.

Show us where in the Quran there is a Palestine. It doesn't actually exist, since the Romans invented Palestine, but, maybe you can re-write the Quran.

Since the Romans invented Palestine, when did Palestinians become Italian?

Israel was created at least 3200 years ago, verified by the archaeological record, and existed not once but twice in antiquity.

Not one Arab country today existed as a sovereign state prior to WW I, they were all invented out of the ashes of the Ottoman Empire.

Israel is the only legitimate country in the Middle East.

You're full of more shit than a Christmas turkey!

Palestinians didn't even exist until 1967. Jews have lived in Judea for 4000 years!

Palestine didn't even exist until the Western Allies resurrected that word after WW I, after 2000 years of not being used.

Pallies are just Arabs and Muslims and there are nearly 30 Arab countries and 60 Islamic countries.

You don't create a state for a fake people. Jews are the only Palestinians since the Romans renamed Judea "Palaestina" 1500 years after Jews had been living there, 500 before Muslims invaded.

Problem is, the entity known as "Palestine" that was reinvented by the British after WW I ceased to exist after termination of the British Mandate and the inception of modern Israeli statehood.

Israel comprises most of the land that was known as Palestine.

The West Bank is correctly known by its biblical name Judea and Samaria.

Make sure you tell the "international cmmunity"

It's a matter of historical fact the Arabs initiated the '47 guerilla war against the Jews one day after issuance of UN Res. 181 conferring Israeli statehood and multiple Arab countries initiated the '48 War.

Furthermore, your Pallies initiated the massacres of Jews in the 1920s and 1930s.

You are in serious need of an education.

You pretend to be educated then you spout crap.

You need not pretend to have zero reputational points, because you're a complete clown.

Have you located those non-existent references to Palestine and Palestinians in the Quran, yet? LOL

Why do you keep bringing up Muslims and the Quran? This is not a religious conflict. Palestine was and still is multi religious. Palestinians are Muslims, Christians, and Jews. These are not competing voices. When it comes to Israel in Palestine, they are all on the same page. None of them want Israel in their country.
