This week, the Supreme Court issued several significant decisions:
- In Truck Insurance Exchange v. Kaiser Gypsum Co., the court held that an insurer with responsibility for a bankruptcy claim is a “party in interest” that can object to a plan of reorganization under Chapter 11 of the Bankruptcy Code1.
- In Connelly v. United States, the court unanimously ruled that a closely held corporation’s contractual obligation to redeem shares is not necessarily a liability that reduces a corporation’s value for purposes of the federal estate tax1.
- In Becerra v. San Carlos Apache Tribe, the court ruled 5-4 that the Indian Self-Determination and Education Assistance Act requires the Indian Health Service to pay contract support costs when an Indian tribe enters into contracts to administer health care programs that the IHS would otherwise operate1.
