And, more importantly, do they need to be?

After all, if you clubbed down a Federal cop while you were 'insurrecting'.....punishment can be up to 20yrs.
Whereas, if you are charged and convicted merely for 'insurrection' the penalty is only up to 10yrs.

The point is that Carlson is trying to advance the lie that the 1/6 rightwing domestic terrorist attack wasn't a rightwing domestic terrorist attack.

More than 1,000 people may face new charges relating to the storming of the U.S. Capitol on Jan. 6, 2021, the Justice Department warned Washington, D.C. courts late last year.
That number comes in addition to the nearly 1,000 people the DOJ had already arrested for Jan. 6 offenses as of February. U.S. Attorney Matthew Graves informed Chief Judge Beryl Howell of the potential prosecutions in an October 2022 letter, according to Bloomberg News. Specifically, the letter stated that the court should expect an additional 700-1,200 prosecutions.
"We expect the pace of bringing new cases will increase, in an orderly fashion, over the course of the next few months," Graves wrote in the letter, according to Bloomberg News. Graves added that it was difficult to predict the exact number of cases due to the "nature and the complexity of the investigation."
Some Republicans on Capitol Hill are becoming increasingly vocal in their opposition to prosecutions of Jan. 6 participants. GOP Reps. Marjorie Taylor Greene of Georgia and House Oversight Committee Chair James Comer of Kentucky are planning to visit Jan. 6 defendants being held in the Washington, D.C., jail in the near future.

This has become the persecution of Americans and violations our Constitutional Rights.
It’s disturbing that there are still people being held in jail cells right now that haven’t had a chance for representation in court. Withholding video evidence of those that have been in court is against the Brady Rule. Everything they’ve been going through is eroding our judicial system. People should be held accountable for their actions, but we have a system of due process with constitutional rights that have been ignored by the DoJ and liberal judges.
There is evidence that the FBI and other govt agencies instigated much of the violence and the DOJ has acted criminally itself by withholding exculpatory information in defense of those convicted and keeping people in prison trying to get a plea deal without a court hearing because they cannot prove the case which violates Habeas Corpus laws. The only way to deal with our corrupt government is to defund the government down to what the constitution allows which would make our country stronger both financially and morally.

"The investigation into the January 6 attack remains under investigation. Our Office of Professional Responsibility is investigating the actions of 35 police officers from that day. We currently have suspended six of those officers with pay," the department said in a statement."

"Videos from the day of the attack appear to show some officers escorting rioters inside the building. In one video, USCP officers can be seen opening barricades allowing the mob to enter the Capitol complex without resistance."

Following the events, the union said that the department's leadership failed its officers by not relaying important information ahead of Jan. 6.

"The disclosure that the entire executive team ... knew what was coming but did not better prepare us for potential violence, including the possible use of firearms against us, is unconscionable," Papathanasiou said. "The entire executive team failed us, and they must be held accountable. Their inaction cost lives."
