UN Arms Trade Treaty Approved

It looks like what would "fit" under the treaty is open to some serious "interpretation."

So, the way in which the treaty could be used to negatively impact gun rights in this nation is actually pretty obvious.

Explain. And quote those parts of the treaty which support your "obvious" negative impacts on our rights.

The primary objection to the UN Treaty is not that it violates the 2nd Amend (even if it did, it would be null and void) and it is not because it would authorize Obama to come after your guns (it does not). The primary objection is that it would authorize Obama via executive order to institute a registration and licensing scheme.

The Treaty includes "Small arms and light weapons" SALW are defined as:

Small Arms and Light Weapons (SALW) is a term used in arms control protocols to refer to two main classes of weapons:

Small arms: hand-held small caliber firearms, usually consisting of handguns, rifles, shotguns, manual, semi-automatic, and full automatic weapons and man-portable machineguns.

Light weapons: Includes a wide range of medium-caliber and explosive ordnance, including man-portable and vehicle-mounted antipersonnel, antitank and antiaircraft rockets, missiles, grenade launchers, rocket launchers, landmines, antiaircraft guns, mortars, hand grenades and rocket-propelled grenades (RPGs), and so on.

SALW - Wikipedia, the free encyclopedia

Ok, so we are certainly talking about firearms which are subject to the the 2nd Amend. That is the first step...

The next step is to take a look at Article 11 which covers diversion. Up to this point, the treaty deals primarily with exports and imports and controls on that... diversion is where the primary legal issues arise.

Under the treaty the countries must establish such controls as are necessary to prevent the diversion of weapons from the domestic market to the international market.

The exporting State Party shall seek to prevent the diversion of the transfer of conventional arms covered under Article 2 (1) through its national control system, established in accordance with Article 5 (2), by assessing the risk of diversion of the export and considering the establishment of mitigation measures such as confidence-building measures or jointly developed and agreed programmes by the exporting and importing States. Other prevention measures may include, where appropriate: examining parties involved in the export, requiring additional documentation, certificates, assurances, not authorizing the export or other appropriate measures.

Under article 12 we then have the record keeping requirement:

2. Each State Party is encouraged to maintain records of conventional arms covered under Article 2 (1) that are transferred to its territory as the final destination or that are authorized to transit or trans-ship territory under its jurisdiction.
3. Each State Party is encouraged to include in those records: the quantity, value, model/type, authorized international transfers of conventional arms covered under Article 2 (1), conventional arms actually transferred, details of exporting State(s), importing State(s), transit and trans-shipment State(s), and end users, as appropriate.
4. Records shall be kept for a minimum of ten years.

IMHO the passage of this treaty by the Senate could be employed by any sitting President to impose nationwide registration and licensing. Simple as that

Hey g, why are you celebrating this? It's not like this has any bearing on us here.

I'm not "celebrating" anything. The foam-flecked idiots have been ranting about this treaty for about a year, without having even read it. One maniac claimed to have read it last year BEFORE it was even written! Morons have no qualms about lying out of their asses and guzzling the piss of special interests by the gallon.

Now that it is available to be read, I find all of their wild-eyed claims to be false, as expected.

There is no "gun grab" in there. I challenge anyone to find one and quote the part of the treaty which grabs yer gunz.

The ATT was just approved by the United Nations General Assembly. Iran, North Korea, and Syria did their very best to block it, but it has finally passed.

You are going to be hearing a great deal of nonsense about the ATT in the coming days. You are going to hear it is a treaty which will allow Obama to come fer yer gunz. You will hear it is a treaty which violates the Second Amendment.

And that is complete bullshit. But don't take my word for it. Read the treaty for yourself: http://www.un.org/disarmament/ATT/docs/Draft_ATT_text_27_Mar_2013-E.pdf

When someone makes a ridiculous claim about the ATT, give them that link and ask them to quote the part where Obama gets to come for your guns, or quote the part which violates the Second Amendment.

Read it. Seriously. Read the goddam thing before you listen to some on air dipshit or foam flecked rabid blogger or watch some paranoid YouTube video accompanied by doom music.

READ IT!!!

The treaty requires exporters of arms to not export weapons to other countries if doing so:

(a) would contribute to or undermine peace and security;
(b) could be used to:
(i) commit or facilitate a serious violation of international humanitarian law;
(ii) commit or facilitate a serious violation of international human rights law
(iii) commit or facilitate an act constituting an offence under international conventions or protocols relating to terrorism to which the exporting State is a Party; or
(iv) commit or facilitate an act constituting an offence under international conventions or protocols relating to transnational organized crime to which the exporting State is a Party.

Small wonder that Iran, North Korea, and Syria tried to stop it.

154 of 193 nations voted in favor of the treaty. That's a slam dunk.

It will become international law once 50 of those countries have ratified it. Considering the overwhelming vote in the General Assembly, that 50 country ratification will probably happen very quickly.

Gun makers are not happy about this treaty. They have been trying to poison little minds against this treaty for a while now, manufacturing all kinds of bullshit about what it is and what it does.

They are going to lose a lot of money if they can't sell arms to shitholes like Iran, North Korea, and Syria or to tinpot dictators.

So read the treaty for yourself. It's not that long. Won't take but a few minutes to read it and arm yourself against the massive landslide of unadulterated bullshit that's about to be shoveled into the mouths of mindless parrots over it.

This is the typical bull shit we've been hearing for a while now. "Obama isn't coming for your guns", or "this won't take away your guns." As if we're stupid enough to not understand that no one will ever try to come get them one day. It's the boiling the frog analogy. You put a frog in boiling water, he'll jump out right away, but you place a frog in water and raise the temperature slowly, you can boil him before he knows it's happening.

That's what Obama, the UN, and the left is trying to do. Don't give me that bull shit. One would have to have the intelligence of a frog to fall for it.

It is a requirement for exporters to keep records of what countries their exported arms went to, to ensure those arms weren't diverted to countries like North Korea, Iran, or Syria.

Those countries which import arms must track the final destination of arms to ensure they were not diverted to countries like North Korea, Iran, or Syria.

Guns made and sold in the USA are not even under the jurisidiction of this treaty. The treaty only applies to arms which cross national borders.

So what kind of drug are you smoking that makes you believe that requirement means nationwide registration and licensing?

Think what you want, I don't give a rat's ass. The end game of the left is to disarm American Citizens, and if it's the end game of the UN that wouldn't surprise me either. You can refuse to believe it, but I'm too smart for that.

So go ahead. I'm waiting.

This is a treaty intended to keep weapons out of the hands of North Korea, Iran, and Syria, dumbass.

You are defending blood money.

Letter A. Just what is the definition of "Peace and Security" within a country? And couldn't that be construed to infringe on the Second Amendment rights of American citizens? I see a giant loophole.

Whereas a law abiding gun owner or manufacturer could hear a line like this:

"According to the UN Arms Treaty, you are hereby adding to the violence and insecurity of this nation by selling or buying firearms. Pursuant to said treaty, we are required to nullify your usage and free exercise/ownership/validity of your firearm/business license. Failure to comply will result in appropriate punishments and/or fines and possible jail time."

The diversion protocols require that steps be taken to insure that weapons in the domestic market are not diverted for illegal export.

Article 5 General Implementation
1. Each State Party shall implement this Treaty in a consistent, objective and non-discriminatory manner, bearing in mind the principles referred to in this Treaty.
2. Each State Party shall establish and maintain a national control system, including a national control list, in order to implement the provisions of this Treaty.
3. Each State Party is encouraged to apply the provisions of this Treaty to the broadest range of conventional arms. National definitions of any of the categories covered under Article 2 (1) (a)-(g) shall not cover less than the descriptions used in the United Nations Register of Conventional Arms at the time of entry into force of this Treaty. For the category covered under Article 2 (1) (h), national definitions shall not cover less than the descriptions used in relevant United Nations instruments at the time of entry into force of this Treaty.
4. Each State Party, pursuant to its national laws, shall provide its national control list to the Secretariat, which shall make it available to other States Parties. States Parties are encouraged to make their control lists publicly available.
5. Each State Party shall take measures necessary to implement the provisions of this Treaty and shall designate competent national authorities in order to have an effective and transparent national control system regulating the transfer of conventional arms covered under Article 2 (1) and of items covered under Article 3 and Article 4.
6. Each State Party shall designate one or more national points of contact to exchange information on matters related to the implementation of this Treaty. Each State Party shall notify the Secretariat, established under Article 18, of its national point(s) of contact and keep the information updated

Article 8 Import
1. Each importing State Party shall take measures to ensure that appropriate and relevant information is provided, upon request, pursuant to its national laws, to the exporting State Party, to assist the exporting State Party in conducting its national export assessment under Article 7. Such measures may include end use or end user documentation.

Article 11 Diversion
1. Each State Party involved in the transfer of conventional arms covered under Article 2 (1) shall take measures to prevent their diversion....

3. Importing, transit, trans-shipment and exporting States Parties shall cooperate and exchange information, pursuant to their national laws, where appropriate and feasible, in order to mitigate the risk of diversion of the transfer of conventional arms covered under Article 2 (1).

In order to prevent the transfer of arms from the US to Mexican drug Cartels thefeds mya conclude that a system of licensing and registration is necessary, all in compliance with record keeping requirements mandated by the treaty. The fact that you do not inderstand that simple explanation is a testament to your intelligence and not my medicinal habits.

Please show me were the treaty applies to internal gun sales.

It doesn't.

That is part of the bullshit being shoveled into your mouth.

At the very worst, the "Peace and Security" provision would prevent arms being exported to the USA by other countries if the UN decided to name us a terror state after the Nazis on the right take over. As if.

It has fuck-all to do with your buying a gun at the local gun mart.

If you would just pay attention to the wording of the phrase. "Would contribute to or undermine the peace and security"

Checkmate. Gun manufacturers may use imported parts and whatnot. So therefore any weapon in the US could be subject to this treaty, therefore subjecting law abiding citizens to the stipulations set forth in this "treaty." Furthermore, people do buy imported guns throughout the US. Which again would subject them to this resolution. It has plenty to do with my buying my gun at the local gun store.

Get your head out of your backside. Stop being so dense. You aren't winning this argument at all.

Looks like you place a lot of trust in the UN. I don't. There is no bullshit when the vague language can be construed to outlaw the importation of lawful guns into this country.
