So a county clerk could refuse to issue hunting licenses or concealed weapon licenses because they believe their religion forbids it?As a public official she is putting her religious beliefs above her official duties. That's a violation of the Constitutional separation of church and state.Why would he...she didn't violate the Constitution.
Amendment I. Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof...
Separation of church and state is NOT part of the Constitution.
She's not making a law, she is exercising her rights. She is saying that she personally, exercising her first amendment right of freedom of religion, cannot be forced by laws of the United States to violate her religious convictions.
That doesn't mean that she can't be county clerk...that would be religious discrimination.
