It was and is illegal by international and American law. That cannot be argued. If we are looking for a prosecutor, might makes right and arresting the guilty presents problems.

It is not clear what the meaning of the question being harped on is. Who decides if going 100 in a 65 zone is illegal? It is illegal even if one is not caught. If one is caught and is more powerful than the cop, are they innocent?
