U.S. District Court Judge Amy Berman Jackson issued an opinion Monday declining a suggestion from the Justice Department and House lawyers that she wipe out rulings she issued in 2014 and 2016 as the GOP-led House was fighting for records about Operation Fast and Furious — a gun-running investigation whose lax practices may have let as many as 2,000 weapons to reach drug gangs and other criminals.


Both sides in the case had appealed her rulings to the D.C. Circuit Court of Appeals, but those appeals were put on hold after President Donald Trump's election as the two sides tried to negotiate a resolution.

In March, lawyers said a settlement had been struck to give additional documents to the House and conduct a new search for some emails. However, the deal included the House agreeing to wipe Jackson's rulings from the books — a move executive branch lawyers sought to avoid them being cited in future disputes with Congress.

The D.C. Circuit sent that issue back to Jackson to see if she agreed that vacating the opinions in the 6-year-old case was appropriate. She concluded the reasons put forward by the two sides were not particularly strong.
