While you were sleeping: Obama transfers 5 Gitmo detainees to UAE

After ten years without a trial....I'd release them all

Its the American way

Late Sunday night (!), the Pentagon announced that 5 Guantanamo detainees were being transferred to the United Arab Emirates. This, despite the fact that today, the president will sign the Defense Reauthorization Act, which contains specific language that would restrict such transfers.

The Sixth Amendment:

In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence.

Had they been charged with any crimes? Had they been tried for crimes? Had it been proven that they had committed any crimes?
too bad.....we didn't start the war......four are low-level fighters but one of them is suspected of having been a bodyguard of OBL.....
Just as I thought.

This country was founded on basic human rights

We have historically released criminals if we lack the evidence to convict them. If the men at Gitmo are dangerous criminals, the burden of proof rests on the United States.
They have a right to see the evidence against them, right to an attorney, right to face their accusor, right to a speedy trial
Holding people indefinitely is not an option
In the absence of a trial, we have an obligation to release them

Amendment VI
In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense.

Sixth Amendment

and under international law:

  • [1] The right to fair trial is provided for in all four Geneva Conventions and in Additional Protocols I and II.[2] Depriving a protected person of a fair and regular trial is a grave breach under the Third and Fourth Geneva Conventions and under Additional Protocol I.[3] Common Article 3 of the Geneva Conventions prohibits the sentencing of persons or the carrying out of executions without previous judgment pronounced by a regularly constituted court.[4] Depriving a person of the right to a fair trial is listed as a war crime in the Statutes of the International Criminal Court, of the International Criminal Tribunals for the former Yugoslavia and for Rwanda and of the Special Court for Sierra Leone.[5]
The right to fair trial is set forth in numerous military manuals.[6] The denial of fair trial is a criminal offence under the legislation of a very large number of States, most being applicable in both international and non-international armed conflicts.[7] The right to fair trial is also supported by official statements and other practice in relation to non-international armed conflicts.[8] There is also national case-law to the effect that a violation of this rule in non-international armed conflicts amounts to a war crime.[9]
The right to fair trial is also included in the Statutes of the International Criminal Court, of the International Criminal Tribunals for the former Yugoslavia and for Rwanda and of the Special Court for Sierra Leone for accused persons appearing before them.[10]

Customary IHL - Rule 100. Fair Trial Guarantees

It goes beyond that

What happens when Americans are held captive without charges on vague charges they are terrorists?
Our complaints will be met with references to Gitmo

Can't bring them to the US . Scared ass republicans made sure of that .

You brave lib/democrats should have volunteered to bring them into your homes and pay to take care of them too. I'm sure Obama would give you our tax dollars for it. You don't have any idea on how I country runs do you? . it's WE THE people, it' not: whatever Obama wants Obama gets.

Do you have a clue what it costs "we the people" to keep GITMO open? Much cheaper to transfer them to a Federal stateside prison.

How about we put them in the homes of the far left drones that want them in the states?

Of course not! They were just sitting around cleaning their AK47 when a US soldier spotted them.

I suggest they all be sent to Washington DC.
