The non US citizens who are currently in the military trying to gain citizenship via military service; is that sufficient enough to earn citizenship? I agree, Congress should enact a law that can then be challenged to limit the scope as "under the jurisdiction of" to clarify that illegal entry does not make a child eligible for birthright citizenship. Birthright citizenship should only apply to those who are in the country legally and place restrictions on those entering the country legally for the express purposes of having a baby on US soil (i.e. baby tourism).

US Constitution, Article I, Sections 9 & 10 make ex post facto (basically retroactive) laws unconstitutional that punish people for changing standards/conditions and applying it to the past.

For example neither the federal or state government can invalidate civil marriages that were legal at the time. If say the legal marrying age was 16 and the state raised it to 18, that would only apply to new civil marriages. The state could not invalidate civil marriages for those 16 and 17 year olds the were legally married prior to the law taking effect.

Time for a constitutional amendment -- where there is a will, there is a way!

We don't know if we need a constitutional amendment yet. I'm in the camp that Congress has the power to limit birthright citizenship to only those present legally by defining "under the jurisdiction of" for the limited purpose of birthright citizenship. Pass such a law and then let the challenge run it's course. If the law is then found unconstitutional, then an amendment would be needed.
