In the mean time, the cigarettes recovered, and some recoveries have been TRUCK LOADS, are then RESOLD to venders that have SPECIAL licenses from the state to RESELL these cigarettes again IN STATE, supposedly brings in a few MILLION dollars a year!

They shouldnt have arrested him. Initially all they wanted for him to move on from where he was. It escalated all too quickly into fisticuffs. That's a failure on their part.

I cannot find anything to bare this out. The video doesnt show it. I have no idea why the police approached him initially. But suddenly there were like 5 of them there. Why? What had he done to attract their attention? I dont see it.

When he started to RESIST ARREST, the officers called for ASSISTANCE, that is when the Black, Female Sgt. showed up, BEFORE any physical contact occurred. They ALWAYS call for a supervisor when there is a PROBLEM, as no officer wants the RESPONSIBILITY of MAKING A DECISION if he doesn't have to....especially now that the current mayor has decreed that the police can be SUED CIVILLY for any of their actions taken.... That's why a SUPERVISOR is supposed to be there, and IN CHARGE!
 
Is there a reason to resist arrest that I haven't heard of yet? All Garner had to do is comply with officers. Is there a legal reason why you think he should have resisted?

That's not really true. police have discretion and can ignore minor law violations, or just tell the person to move on.

Take the Brown situation, no doubt if they hadn't cursed at Wilson and acted like idiots, he would have kept on driving after telling them to get out of the road.

You ABSOLUTELY have the right to resist an unlawful arrest. BUT the onus is on you to prove the arrest was unlawful.

"I was innocent" doesn't make the arrest unlawful.

Garner had experienced 30 arrests he should have had experience enough NOT to resist.

Always. You always try to use the least amount of force to deal with the situation you can. That's just a basic police principle.

Always. You always try to use the least amount of force to deal with the situation you can. That's just a basic police principle.

They were only issued to Emergency Service officers, and as your article states they are NOT available to officers currently.

But what makes the Garner case so much different than Michael Brown’s is that the Staten Island killing can’t be called a racial incident.

Pantaleo who applied the lethal chokehold on Eric Garner was supervised by an African-American female NYPD sergeant.
Having that black sergeant in charge of that crime scene takes race out of the equation. As awful as Pantaleo’s actions appear on that video, at no time does that black sergeant order Pantaleo to stop choking Garner. Decision not to indict cop in Eric Garner death a disgrace - NY Daily News
