What Trump needs to do, if he really wants to win this... is have a WIN in one of the other District court of appeals, so that when it does go to the Supreme court, there are 2 conflicting District court rulings.... going to the SC with only the LOSS in the 9th, would not be in his favor....and the possibility that the SC does not take the case is there....

But with two conflicting courts, one in his favor, one against him, the SC would be compelled to hear the case.
