The move puts the Biden team in the curious position of seeking to maintain secrecy surrounding legal decisions of the Trump era.
The Justice Department on Monday released more of a key legal memoconcluding that former President Donald Trump did not commit obstruction of justice through his alleged attempts to thwart federal investigations, including Special Counsel Robert Mueller’s probe into ties between his 2016 campaign and Russia.
However, top Justice officials filed an appeal to try to keep the majority of that nine-page legal opinion under wraps, despite a judge’s order earlier this month requiring that the legal memo be released in its entirety.
The move to appeal the judge’s ruling rather than meet a Monday deadline for release of the legal opinion puts the Biden administration in the curious position of seeking to maintain secrecy surrounding some of the most pivotal legal decisions of the Trump era.
The Justice Department signaled its split decision on the disputed memo in a brief court filing submitted at about 10:30 p.m. Monday.

Shame on the Biden DOJ. We deserve to see that memo! Even U.S. District Court Judge Amy Berman Jackson thinks the memo should be released.
