In other words, he'll die.

Treason is a stretch, though I suppose one could make a case.
Timothy McVeigh, however, was not tried for treason. He was convicted of

Count 1 -- Conspiracy to use a weapon of mass destruction.
Count 2 -- Use of a weapon of mass destruction.
Count 3 -- Destruction by explosive of government property.
Counts 4 -11 -- First degree murder for each of eight federal agents killed in the explosion.

So what? He spends the rest of his life in a prison cell. It isn't right to kill him just to say that killing is wrong.

Is "Use of a weapon of mass destruction" a capitol offense? The deaths and injuries to the civilians and police officers are state offenses.

If they define it as an act of terror as Obama declared on national TV, I think that makes it a federal case due to terrorism. But I am no lawyer.
