I'm a Centrist... I am part Federalist and part Home Rule type... and Home Rule is fine, so long as it does not contradict Federal Law.

You know... the way the Constitution and 230 years of judicial rulings indicate... Federal Law controls in the face of any conflicting local statute.

Time to begin teaching a lesson in the supremacy and power of Federal Law, using Kalipornia as the object of the exercise.

Does the Federal government have the Constitutional authority to impose Federal law within a state? The Constitution actually says no- but court interpretations have gone both ways.

We will see how it plays out.

You DO realize that the Judicial Branch of government cannot add or fabricate language to or out of the Constitution without the Legislature amending it first? You're going to find that out sooner or later...even about decisions made a couple years back under the fascist Obama administration/judicial..

You know what's funny about that DOMA decision? It found 56 times that marriage is the power of the states to decide, not the fed. Then came Obergefell and turned that exactly around 180 degrees. You want it both ways all the time, crafted and disrespectful of the written language of the Constitution to fit whichever whim the left wants to suit itself in the moment.

Once pot friendly Northern California county bans marijuana

Well the games have begun. Lawsuit coming..

four new board members were seated this month after winning election in November on campaign promises to ban marijuana.....Calaveras County growers with permits said Wednesday they are planning to sue. Each permit cost $5,000 and the county has collected more than $7 million in taxes from marijuana growers since 2016....The farmers also said they may try to qualify a ballot measure to reverse the ban....Ban proponents complained that a sudden influx of new marijuana growers dramatically changed the region's makeup and damaged the environment.

In order to get a ballot measure approved, it first must not violate any State or Federal laws. This should get interesting...

All these opinions, and no one has addressed the real issue.

Well at least that one County has sniffed the wind & is backing out. Wonder if more there & in other "legal" states will too?

In this case- for whatever reason- the voters of the county don't want commercial growers in the county- and voted in a slate of supervisors that ran on that platform.

Doesn't prevent the legal sale of pot in Calavaras county at all.

"Subject to constitutional guarantees." You always omit that part of the Windsor ruling and then pretend that by ignoring it, the courts had to as well.

They don't. And they didn't. As it was those exact constitutional guarantees mentioned in the Windsor decision that were the basis of the Obergefell decision. You simply ignored them.

So....how'd that work out for you?

Nonsense. The Obergefell ruling was utterly predictable with the Windsor court clearly indicating where they were going on the issue of the right to marry.

It as so clear in fact that Scalia in his dissent of Windsor called a ruling like Obergefell 'inevitable' and 'beyond mistaking' and even described how the Windsor ruling justified a future ruling like Obergefell. We here on the board told you the basis that the courts would cite, even gave you the cases the court would cite in recognizing same sex marriage as a right.

You ignored us all, ignored Scalia, ignored the Windsor ruling and then insisted that you knew better.

Laughing....nope. It wasn't the Supreme Court that was confused about the Windsor ruling. It was just you.
