Of course more people are going to die if these drugs are legalized. First of all, smoking in general is just bad for you. Secondly, you have the issue of altering your mind that will cause a variety of fatalities. Then you have the added issue of all the secondary problems the drug in question may cause depending on the side effects. And yes, all drugs have side effects that are not being monitored by a doctor.
