The constitution says congress has the authority to declare war. They cannot give that authority to the president by statute. We must go thru the amending process which means 3/4 of the states must approve.

Until the constitution is amended, there can be no war unless congress declares one. Without such a declaration every soldier has the right to refuse orders to fight.

Do a little research and you will see the massive list of conflicts we have been in almost since the end of the revolutionary war, with very few involving a Declaration of war.

Everybody knows that, you idiot. But just because other presidents have started wars without a congressional declaration does not make it right. It's time to stop this brazenly unconstitutional practice of presidents starting wars. Congress must FORMALLY DECLARE A WAR or it's no go and every soldier has the right to refuse to fight. THINK
 
War is a serious matter and a declaration should be made. After ww2, we have been in several debacles that were undeclared and public opinion/support wasnt there mainly because we had no business being there. Obviously, we have learned nothing from the romans.

Should be??? Is that all you have to say? The declaration absolutely has to be made if the constitution is to have any value.
 
There have been a variety of challenges using this strict interpretation in the past and the Courts have always shot them down as Unrealistic.

obama isn't looking for a declaration of war. He only wants to go in for a limited strike. Congress can authorize a one time use of force that falls short of outright war.

That's your opinion. This has been debated by Congress. The conclusion they came to is that they can.

While those who hold your opinion are discussing it in internet forums, Congress will go ahead with authorizing force and issuing declarations of war as it decides to do.

I think Kondor3 was just being sarcastic saying they could vote no for this BS.
 
They could vote no. Then there is the question of whether obama has the authority to order anything. Even if someone believes that obama could use military force in the absence of Congressional authority, it is an entirely new question of whether he could use force once authority has been denied.

Like it or not, any attack is not going to happen in a vacuum. The decision to go to war is not ours alone. If we attack and the country we attack, along with its allies, consider it an act of war and they declare war, we are in a war that the presidunce and congress did not intend.

You are wrong about that one. Not only does congress have the authority, the president doesnt need their permission to attack someone. As commander and chief he can start a conflict without congressional approval. Congress can effectively cut him off by not funding any action.

Join the Army and refuse to follow orders. I one less nut on the board is always nice.

Which means nothing. The Courts have no authority to rewrite the constitution and the states need to say that. If you want to change the constitution, you have to go thru the amending process.
