Amid credible allegations of election fraud in North Carolina, Democratic leaders announced Friday they will not seat Republican Mark Harris, who ran in the state’s 9th District, and will instead leave the House seat vacant.

“Given the now well-documented election fraud that took place in NC-09, Democrats would object to any attempt by [Mark] Harris to be seated on January 3,” incoming House Majority Leader Steny H. Hoyer (D-Md.) said in a statement to The Washington Post. “In this instance, the integrity of our democratic process outweighs concerns about the seat being vacant at the start of the new Congress.”

The title of the article seems a little misleading. AFAIK it's the state elections board (now dissolved) which refused to certify the result, thus preventing Harris from being seated. The quoted Democrat just said they would object to him being seated. There was a hearing scheduled which is now apparently in limbo given that the board has been dissolved, but I imagine the outcome will be decided by courts, probably by calling for a new election, or so I would bet given what's been reported. In any case, it's not a question of Democrats refusing to do anything. They don't control the process unilaterally. At this point they are just parties to a legal dispute.

NC has not certified the winner of the election so Democrats have every right to refuse to seat him. Apparently a new board will not be convened until Jan 31. Even Republicans have conceded a new election may need to be held.
