Dinesh D'Souza indicted for violating U.S. election law

He made a claim. It has not been confirmed.
Oh yeah, he made the whole thing up, right? Claims he was audited by the IRS and Obama just let it slide. Deny much?

He made a claim, and did not back it up with any paper evidence.

He could just as easily have brought the audit forms with him on to the show. If the IRS audited him, this means they left a paper trail that he can easily produce. It's that simple.
Sure, and Chris Matthews (or any other lefty in the media) wouldn't have already challenged his claim. Say it: D E N I A L.

Ladies and Gentlemen of USMB:

Dinesh D'Souza in this context, is the canary in the coal mine.

His political persecution is a sign that it is no longer safe for ANY of us to cross Obama.

What are we going to do about it?

Here's a letter emailed to me by Gerald Molen, Co-producer of the documentary, "2016: Obama's America."

Dear Friends of Dinesh,

In America, we have a long tradition of not doing what is commonly done in too many other countries -- criminalizing dissent through the selective enforcement of the law. But that has seemingly changed in Obama's America.

Yesterday, I explained the politcally-motivated events that led to Dinesh's indictment on campaign-finance charges to the Hollywood Reporter. In the same article, I explained that the Feds have chosen to pursue this alleged minor violation in the same way the IRS targeted conservative Tea Party groups for retribution. In light of the way the IRS has been used to stifle dissent, this arrest should send shivers down the spines of all freedom-loving Americans.

Our production team for America has issued the following statement: "We believe this is an unfortunate misunderstanding arising out of Dinesh D'Souza's desire to help the uphill campaign of a friend. There was no intent to do anything illegal or corrupt in any way. This will have no impact on the film America, which will be released on the Fourth of July this year as previously announced. Filming is on schedule and D'Souza will continue to lead the enterprise."

Neither the filmmakers nor the American public can allow this prosecution to deter us from the film's release, and I am calling upon the American people to show their elected officials that this kind of selective prosecution will not stand by joining us at the box office.

I look forward to my good friend Dinesh being vindicated as we hold federal authorities accountable to enforce the law equally and without mind to their personal political agenda. You can leave your support on Dinesh's Facebook Page and with a #StandWithDinesh tweet.

As one insightful commenter wrote on the article in THR, Obama's DOJ is out to settle scores.

All my best,
Gerald R. (Jerry) Molen

"2016: Obama's America"

Dinesh D'Souza is accused of giving too much money to a candidate who sought to replace former New York Sen. Hillary Clinton. Producer Gerald Molen tells The Hollywood Reporter the charges are politically motivated.

Conservative filmmaker Dinesh D'Souza, whose documentary 2016: Obama's America took a critical look at President Barack Obama and was a surprise hit in 2012, will be arrested in New York on Friday for allegedly violating campaign-finance laws, The Hollywood Reporter has learned.

Federal authorities accuse D'Souza of donating more than is legal to the campaign of Wendy Long, who ran in 2012 for the U.S. Senate seat vacated by Hillary Clinton but lost to now-Sen. Kirsten Gillibrand. Long, though, is not mentioned in an indictment obtained by THR on Thursday.

Insiders say D'Souza has been friends with Long since they attended Dartmouth College together in the early 1980s. According to the indictment, D'Souza donated $20,000 to Long's campaign by aggregating the money from various people and falsely reporting the source of the funds. But Gerald Molen, a co-producer of 2016, says the charge is politically motivated.

"In America, we have a long tradition of not doing what is commonly done in too many other countries -- criminalizing dissent through the selective enforcement of the law," Molen tells THR.

STORY: Jeffrey Katzenberg's Secret Call to Hillary Clinton: Hollywood's 2016 Support Assured

D'Souza first learned he was being investigated in the middle of 2013, several months after 2016 had earned $33 million at the box office and become the second-most-popular political documentary in U.S. history. The film included an interview with Obama's half-brother, George Obama, who was mildly critical of the president.

Molen says D'Souza is being singled out for "an alleged minor violation" in the same way the IRS reportedly targeted conservative Tea Party groups for retribution. "In light of the recent events and the way the IRS has been used to stifle dissent, this arrest should send shivers down the spines of all freedom-loving Americans," Molen says.

D'Souza was in San Diego working on his next film and book, each to be called America, when he was informed he was about to be indicted and that he should fly to New York and turn himself in to authorities. The indictment came late Thursday, according to those with knowledge of the situation.

D'Souza's upcoming film America is due in theaters July 4 and is co-produced by Molen, who won a best picture Oscar for Schindler's List, and Gray Frederickson, who won a best picture Oscar for The Godfather Part II. D'Souza wrote and stars in the film, which is directed by John Sullivan. The filmmakers emailed a statement to THR vowing to release the film on schedule.

FILM REVIEW: 2016: Obama's America

"We believe this is an unfortunate misunderstanding arising out of Dinesh D'Souza's desire to help the uphill campaign of a friend," the statement reads. "There was no intent to do anything illegal or corrupt in any way. This will have no impact on the film America, which will be released on the Fourth of July this year as previously announced. Filming is on schedule and D'Souza will continue to lead the enterprise."

Sources say D'Souza has been cooperating with authorities. He will surrender Friday for processing and be arraigned in the Southern District of New York.

Benjamin Brafman, an attorney for D'Souza, tells THR that his client "did not act with any corrupt or criminal intent whatsoever ... at worst this was an act of misguided friendship by D'Souza."

Molen added: "When American citizens begin to suspect that people are being arrested for alleged minor violations because of their vocal dissent against their elected representatives or rulers, it breeds disrespect and contempt for the law and suspicion of those officials. … If this unfortunate action against Dinesh is intended to deter the release of his upcoming film, America, that effort will fail."

A world renowned Neurosurgeon who is known for his integrity is usually taken at his word and doesn't feel the need to produce evidence of something he can certainly prove.

You have burst the bubble you once inhabited where I thought you were one of USMB's more intellectual posters.

You are actually a partisan clown.

I guess if I paid more attention to you I'd have realized the truth about you sooner than I have.

Oh well.

I guess my basic instincts to ignore your posts was spot on accurate, anyway.

Wow, such spin. So what of those Tea Party groups? Did they commit grievous crimes to get investigated by the IRS like that? Hey, Ben Carson gets audited for embarrassing the president during that prayer breakfast. What was his crime?

So, where is this proof that either of these men committed a crime?

I disagree with the IRS targeting Tea Party members, but there is nothing linking Obama to that incident. With Ben Carson, there is no proof he was targeted for his views. People get audited for stupid shit all the time. As TheDoctor said, really wanting it to be true doesn't make it true.

The reason why so much of the Tea Party has been audited is because most all Tea Party chapters applied for tax-exempt status, claiming they are not political. This is, of course, a lie. The very reason for the existence of the so-called Tea Party is political to the core.

Many Tea Party chapters ended up bringing in money for the Romney campaign, they advertised for him on their websites and at their events. That makes them quite political and in that moment, they should have lost their tax exempt status.

The IRS also investigated a number of left wing groups for the same as well.

In other words, by and large, the IRS was doing it's job.

Oh, and a number of the lower employees deeply involved in this? Republicans. Registered Republicans.

There were FEWER Leftist groups investigated.

Oh, and here is the Investor's Business Daily article re:Ben Carson's being audited.

Ben Carson's IRS Audit Can't Possibly Be Coincidence

IRS Abuse: It doesn't take a brain surgeon to know that the IRS audit of Dr. Ben Carson can't be a mere coincidence. In any powerful syndicate, the capos know who to whack without the godfather ordering it.

The only way the FBI could put Gambino crime family boss John Gotti in prison was to bug an old lady's apartment in New York's Little Italy and record him giving orders to kill.

But until the FBI bugs the West Wing of the White House, or the Treasury building next door, or the Internal Revenue Service's headquarters a few blocks to the southeast, we might never know the exact origin of America's tax collectors harassing President Obama's political adversaries.

Maybe there was never an explicit order. Considering the threat of being overheard, it's part of the job of the capos to know what the boss wants and make him happy by giving it to him without him even having to ask.

The IRS and the Obama administration are on the same page when it comes to big government: Tea Partiers and other conservatives threaten the massive state they love, and the IRS' powerful army of bureaucrats is a pretty handy weapon for use against them.

In the already blossoming IRS scandal, political organizations' applications for tax-exempt status were delayed or denied during last year's presidential campaign, and well into this year, simply because their names sounded too conservative. The IRS audit of renowned neurosurgeon Carson looks like exactly the same kind of abuse, and it must be subject to a formal independent investigation.

Carson on Wednesday told Fox's Bill O'Reilly that the IRS began examining his real estate holdings after his speech to the National Prayer Breakfast in February, in which he used tithing in the Bible to make a compelling case against progressive taxation. A humiliated Obama sat steaming a couple of seats away.

Carson said, "there must be something inherently fair about proportionality. You make $10 billion, you put in a billion. You make $10, you put in $1."

The black Detroit-born son of a single mother, who rose from poverty to the top of the medical profession, added, "Now some people say that's not fair because it doesn't hurt the guy who made $10 billion as much as the guy who made $10. Where does it say you have to hurt the guy? He's just put in a billion in the pot. We don't need to hurt him."

Interestingly enough, a guy like Micheal Moore doesn't even so much as raise an eyebrow...

Michael Moore has not been indicted for breaking campaign finance law.

Nonetheless, it seems conservative film makers are drawing all of the scrutiny. Nobody really addressed why it took the government over a year and two months to "indict" D'Souza...

Mind you, if he did break the law, he should be punished under the fullest extent of the law; however if these turn out to be trumped up charges... well we'll cross that bridge when we get there.

it is still a matter of Carson making a claim that he has not backed up.

All DBI did was to quote from Fox. There is no new information there.

But to imitate how so many Righties have constantly demeaned our President, I guess I'll just have "to take him at his word".

But should it come out that he lied, I will be laughing at you until the Messiah arrives!

:)

Wouldn't be the first time that a Rightie was caught in a lie, even recently...

You can ask Norman Hsu how "nothing" this "infraction" is. He'll be out of prison in 2030.

So D'Souza funneled campaign donations on behalf of a foreign government?

Without demagoguery, democrats would be rendered utterly silent.

This is nothing more than a political hack-job by the Shock Collar to the Chicago Gangster. Even the OP pointed out that the penalty if convicted is a fine.

BTW, Hsu is convicted of money laundering, mail fraud and running a pyramid scheme. There were no convictions related to his funneling cash from the Communist Chinese to the DNC - though he certainly did do this.

Again, you're not using the word "fact" properly.

Actually I am.

I realize that to you, "fact" is something that serves the party.

In realty though, it is an item that is verified to have occurred.

{The FBI finally has begun to contact some of the tea party groups targeted by the Internal Revenue Service for inappropriate scrutiny in the first public signs that the administration’s criminal investigation is progressing.

The IRS targeted enemies of Obama - that is an element of irrefutable fact, even if it doesn't serve your shameful party.

Really wanting something to be a "fact" doesn't make it one.

Really loving your party and wanting to serve it doesn't alter reality.

Dinesh D'Souza indicted for violating U.S. election law

BY JONATHAN STEMPEL

NEW YORK Thu Jan 23, 2014 6:03pm EST

Jan 23 (Reuters) - Dinesh D'Souza, a conservative commentator and best-selling author, has been indicted by a federal grand jury for arranging excessive campaign contributions to a candidate for the U.S. Senate.

According to an indictment made public on Thursday in federal court in Manhattan, D'Souza around August 2012 reimbursed people who he had directed to contribute $20,000 to the candidate's campaign. The candidate was not named in the indictment.

Attempts to reach D'Souza and a lawyer representing him were unsuccessful.

D'Souza was charged in the indictment with one count of making illegal contributions in the names of others, and one count of causing false statements to be made.

Federal law in 2012 limited primary and general election campaign contributions to $2,500 each, for a total of $5,000, from any individual to any one candidate.

"As we have long said, this Office and the FBI take a zero tolerance approach to corruption of the electoral process," the U.S. Attorney for Manhattan, Preet Bharara, said in a statement released by the Federal Bureau of Investigation. Bharara is an Obama appointee.

Born in Mumbai, India, D'Souza, 52, is a former policy adviser to President Ronald Reagan, and has been affiliated with conservative organizations such as the American Enterprise Institute and the Hoover Institution at Stanford University.

He also directed a 2012 film critical of President Barack Obama, "2016: Obama's America," and has written books including "The End of Racism," "Life After Death: The Evidence" and "Obama's America: Unmaking the American Dream."

D'Souza campaigned in 2012 on behalf of Wendy Long, a lawyer and Republican who sought to unseat Democratic incumbent Kirsten Gillibrand as New York's junior senator. Long graduated from Dartmouth College in 1982, a year before D'Souza.

Long could not be reached for comment on Thursday.

Gillibrand, herself a 1988 Dartmouth graduate, ended up winning re-election to her first full term, collecting close to 72 percent of the vote.

In late 2012, D'Souza resigned his post as president of King's College, a small Christian college in New York City, after admitting he had become engaged to a woman even though he was legally married, though separated from his wife. He has been an outspoken defender of traditional marriage.

The case is U.S. v. D'Souza, U.S. District Court, Southern District of New York, No. 14-cr-00034.

This nation has invited in this virus residing in the WH.

Here is plain and obvious proof of politically motivated persecution by departments of the Government at the behest of barack Obama.

D'Souza was going to debate Bill Ayers at the end of the month.

I guess Barry feared what Bill might have said.

Like confirming that he and not Barry penned, "Dreams From My Father."

Obama is a scum sucking dog.

A Chicago hood.

A third world inspired Marxist who gives not a shit about anything but him, his benefit and what will make him look good.

Maybe he is saying to the Conservatives, "See what happens when even one of your notable celebrity Conservatives asks too many questions or makes me angry?"

I can't say for the moment whether this will produce more than a wave of outrage on the internet or not.

Think it might be the straw that broke the camel's back IF D'Souza is innocent.

It looks bad.

Highly political.

It is reckless, destructive and indefensible.

IF D'Souza is a victim of unwarranted targeted political persecution.
It turns out you were wrong...

all you people do is fucking lie
The man pleaded GUILTY.

If you look at all the news and blog reports on this story you see nothing but DEFENSE and even POUTRAGE from the RW Republicans claiming it's Obama's wrong doing. Everything BUT take PERSONAL RESPONSIBILITY from the party of "personal responsibility"

Bullshit, they dropped voter intimidation charges against the black panther thugs in Philadelphia AFTER the case had already been won. That's what makes it selective prosecution. You're a hypocrite.

Another example of selective prosecution. All of the foreign (and illegal) donations to Obama's campaign that were ignored, not to mention all the law breaking by his administration since he's been in office.

He's increasingly being called a lawless president. And this period in our country's history is being called post-Constitutional.
By WHO?!? Gotta link?
