A random state court can not declare the capitol riot an insurrection.
When that happens during protests we have a name for it… riot. We correctly call the destruction elements riots without charging everybody with “rioting” they get charged for the specific crimes they commit.There was no real plan other than to protest. It got out of hand and they trespassed, damaged some federal property and some people got hurt. It isn't any different than the many protests that got out of hand across the US, other than the fact that they caused much more damage and people died.
