A random state court can not declare the capitol riot an insurrection.

False. Others have been banned from public office under the purview of the 14th Amendment without ever being charged with insurrection.
 
There was no real plan other than to protest. It got out of hand and they trespassed, damaged some federal property and some people got hurt. It isn't any different than the many protests that got out of hand across the US, other than the fact that they caused much more damage and people died.
When that happens during protests we have a name for it… riot. We correctly call the destruction elements riots without charging everybody with “rioting” they get charged for the specific crimes they commit.

When this happens at our nations capital to stop the certification of votes it is called by definition an insurrection. Just as when it was don’t Seattle to take over a police station, it’s also an insurrection.

How do so many people not comprehend simple definitions? What happened is exactly the word insurrection means. If you disagree show a definition that states otherwise. Here is mine:

No they did not. Trump has not been charged or convicted of participating in any insurrection. Partisan opinions don’t count.

The SCOTUS will reverse that decision and stop other blue states from doing the same.
He doesn’t need to be charged in criminal court to be accused or found guilty in civil court. Brian up on your understanding of the law. If you disagree with what I just said show the statute to back up your argument

That speech, combined with the many other attempts to illegally overturn the election, plus his complete dereliction of duty during the attack on the Capitol all prove that he was attempting an insurrection against democracy.

SCOTUS has every right to do that and they just may. What would their legal argument be. Which law or constitutional amendment does the CO decision violate and why?
 
Using this definition, we certainly would have to call those that took over a police station and and entire city block in Seattle for a couple of days insurrectionists. Strangely, that never happened either.

How can someone be disqualified for committing a crime which they were never charged with let alone convicted of. A person can’t be disqualified based on a political opinion of their fitness for office. That’s up to the voters.

No judge has found Trump guilty of participating in an insurrection as he’s never been charged or tried for that.

Section Three makes no mention of disqualification being based on convictions of crimes.
