Feds not prosecuting gun criminals who straw purchase guns…want to pass new laws despite this..

The local, state and federal law enforcement agencies and judicial branch judges will not prosecute gun criminals……so they want to pass more laws they won't enforce….makes perfect sense if you are a lefty….

Stopping and reducing illegal gun trafficking is a laudable cause, but this legislation won't make a difference because the feds already fail to enforce similar laws already on the books. In fact, even possible presidential candidate and Vice President Joe Biden has admitted the Department of Justice "doesn't have time" to prosecute people who lie on background check forms or straw purchasers who play a large role in the gun trafficking problem. Also, a reminder of former ATF Director B. Todd Jones' confirmation hearing:

Mr. Jones acknowledged in questioning by Sen. Ted Cruz, Texas Republican, that of 48,321 cases involving straw buyers, the Justice Department prosecuted only 44 of them — saying that “hard decisions” to prosecute were made based on “limited resources.” He also acknowledged that as the U.S. attorney in Minnesota, he never prosecuted anyone accused of being a straw buyer.


Piling more bureaucracy on top of an ineffective system doesn't do anything to prevent gun trafficking, but in fact fuels corruption.
 
The background to this is VERY simple. It's the same reason why criminals are rarely actually prosecuted for possession of a firearm during the commission of a crime......

Those crimes come with MANDATORY SENTENCING GUIDELINES of one to five years in prison. Considering the punch those charges pack, District Attorneys use them as leverage to get cooperation or plea deals to lesser charges instead of pressing the Federal Charges.

For example.... Massachusetts has a mandatory one year sentence for possession of a firearm during the commission of a crime (whether you use/show it or not). That's been in place since 1998. I don't believe it's EVER been used. The DA's plea bargain it away to get guilty pleas to lesser charges which rarely come with any mandatory time. On the other hand both Texas and Virginia saw considerable drops in the number of criminals carrying firearms when they started prosecuting the criminals under the 5 year MANDATORY Federal Sentencing Guideline for doing the same thing.
 
Imagine the change in behavior if they prosecuted and sentenced criminals to long sentences for using guns in the commission of a crime…they would start using knives very quickly…..Just like the organized criminals in Japan avoid guns because of the stiff penalties….
