The larger issue is the questionable theory of inherited grievances. This used to be dismissed as a fruitless Hatfield/McCoy exercise, but has been recharacterized as a question of racial justice. Aside from the obvious question of who can claim a particular ancestor, the larger issue is about making these race-based judgements in the first place. Are we not contradicting the premise that all men are created equal? Do we want to establish official recognition that, even at birth, members of a particular racial group are presumed to have inferior potential and must receive special treatment their entire lives? Aren't these lowered expectations a greater burden than any historical transgressions against one's ancestor?
 
I agree, we should do more to separate the different races of people
 
Looks like the court has struck this type of election down before and will do it again.
