There is already precedence though, it has already been established in the SC, with the Nixon Impeachment hearings, the oval office tapes were relevant to the impeachment, thus executive privilege did not apply.

Thus all the rulings in the McGahn trial have ruled in the House's favor, the precedence set on it.

The suits are stall tactics, they know the end result won't be with him, imo.
