Are you insane or something? If he is compensated, and refuses the compensation, there is no constitutional violation. He was "offered" compensation which is all that the Constitution requires.

If I help a little old lady clean her garage, and she gives me a check for $500.00, and I don't cash that check, I don't have to pay tax on money I never collected.
