This is just the turn of luck I have been waiting for. Why is Cruz not constitutionally eligible to be president? Here's why:
Cruz acquired citizenship because both his citizen parent and he met the requirements of naturalization statute, specifically Pub.L. 82–414 § 301(a)(7); 66 Stat. 236.
For the child who acquires citizenship by § 301(a)(7) to retain citizenship the child must meet the requirements of § 301(b).
A natural born citizen does not need to take affirmative actions to retain citizenship. A natural born citizen must take affirmative actions to renounce citizenship. A naturalized citizen must comply Congressional Act.
His citizenship is granted by Congress, i.e. he is naturalized.
The retention requirements where eliminated in 1978, which in no way changes the fact that he is a naturalized citizen. He citizenship is by Congressional grant.
The Supreme Court in U.S. v. Wong Kim Ark is quite clear on this point: statutes “conferring citizenship upon foreign-born children of citizens” is naturalization, not natural born. You see, he's a statute citizen. A statute citizen (bestowed by man's pen) can never be made into a natural born citizen (bestowed by God/ nature)
