What is revision? The elected Parliament followed the Constitution of Ukraine and impeached the President, appointed a temporary one and scheduled an election. They followed their constitution.

The legitimacy of the impeachment is certainly up for debate. And that debate will rage on long past the new election at the end of May. And the dueling constitutions gives this another bizarre twist.

Yanukovych with all hell breaking loose because this was not a "peaceful protest" this was a violent coup fled for his life and wasn't able to sign the agreement that had been brokered with the EU and the Opposition saw the opportunity to overthrow Yanukovych and seized power.

But a legal gap remains. According to the terms of an EU-brokered peace deal finalized on February 21, Yanukovych was due to sign a measure returning Ukraine to its 2004 constitution. (In 2010, Yanukovych restored the country's 1996 constitution, which hands greater power to the presidency.)

Yanukovych, however, failed to sign the measure. The omission appears to leave Kyiv in the kind of legal limbo that may prove fodder for future arguments against the current government transition.

The 1996 and the 2004 constitutions are uniform when it comes to the reasons for removing a president, with Article 111 stating the parliament has the right to initiate a procedure of impeachment "if he commits treason or other crime."

However, it is not clear that the hasty February 22 vote upholds constitutional guidelines, which call for a review of the case by Ukraine's Constitutional Court and a three-fourths majority vote by the Verkhovna Rada -- i.e., 338 lawmakers.

Pro-Yanukovych lawmakers may also argue that under the 1996 constitution, it should have been the current acting prime minister, Serhiy Arbuzov, who assumed power after Yanukovych's removal.

The 2004 constitution designates the parliament speaker as the No. 2 position.

It appears the scolding Obama gave Putin over Crimea may not be having the chilling effect on Putin some thought it would it also looks like the much talked about Putin call to Obama may not have been Putin begging for mercy. Now for how Obama should respond move naval assets especially aircraft carrier into the region and announce publicly that we will support the Ukraine government and send them supplies and arms if Russian troops invade again please note I said nothing about sending in U.S. troops or getting involved directly in any fighting. The purpose of this would be as a show of force and resolve and to let Putin know if he crosses the border again he will pay a price because he will be facing a better trained and more importantly a better armed force than he did when going into Crimea.

What should obama do?

It's too late for him to do anything. The time to act was long ago, like at the time of the reset button debacle.

What not to do is offer military aid to the failing Ukranian coup. Such an action will turn Ukraine into Syria. This is ultimately a civil war. We can help in the murder of another 200,000 people or let the Ukrainians vote their way out.
