Rand is making some comments to sway the far right and libertarians.

He simply does not want to understand how the Constitution works.

Taxation pursuant to our laws is legal: end of story.
Taxation is not theft when it is used to pay for our defense or build roads.

Taxes, and other forms of government intervention in our lives, become theft when they are used to transfer wealth, and that is what Rand Paul is talking about. For example, forcing someone to buy health insurance at rates higher than they normally would have so that a high school dropout can get free health insurance is theft.

By the feds, it is. Unless it's postal roads of course, and that means routes between post offices which are necessary to move mail. The interstate highway system was initially justified under common defense, to move personnel and material over long distances more efficiently, of course the politicians have bastardized that concept beyond all recognition.
