it.Within a few days Ray Epps status on the FBI most wanted list
drastically changed.

He only said to go into the Capitol the night before. Incitement requires immediacy. You can’t be accused of inciting a riot by saying something the day before. It doesn’t work that way.

Furthermore, Epps could rationally claim that he had no idea the Capitol was closed on January 6th. The Capitol is historically a very open building. He can’t be criminally liable unless he was aware he was encouraging an illegal act.
