Remove Education From the Federal Government

5 year olds don't know what "sexual misconduct" is.

But notice that most adults do.

Well, gotta' introduce them to the "Prison Industrial Complex" eventually so might as well start em young!

I disagree. It's sick. The education system is as corrupt as our government. Education needs to be removed from federal control. Communities and the individual states can do it without this sick crap.
 
The federal Department of Education was only formed in 1979 by Jimmy Carter. It was an experiment that didn't work. Get rid of it.
 
If it is gotten rid of that's fine with me... then also there should be NO federal tests given so that each state takes the same test. Also, no state testing either. If the locals want to put a test together, let the local teachers, school boards, and parents do that so they know exactly what concepts to be taught so those are the ones that are tested. In other words teach to the test... sounds bad but if that's the measure then why teach other things? Then let's look at test scores.
 
So when was the "golden age" of education in the United States?

I'm not certain what Federal guideline is being used to label the behavior "Sexual Misconduct."

The CBS article you have linked says:

“Our school district uses consistent language for disciplinary infractions in order to provide clarity and track discipline data accurately,” assistant superintendent Jim Dean said in a written statement to KTVK.

He explained that the district must follow the state and federal guidelines and definitions that are set to define a sexual offense.

AZ SAFE is an initiative sponsored by the state which helps districts collect information and clarify it. The state recommends that each district take into account the age and maturity of a student before placing their actions in the sexual offense category.​

A. Only Arizona State Guidelines are used (No specific Federal Guidelines are mentioned).

B. GUIDELINES are not RULES or LAWS. The district can interpret them any way they wish.

C. The state clearly recommends that districts use discretion.

Sounds like the district and Jimmy Dean are fucked up.
