A good example of a justified light sentence, my nephew. He and his wife were asleep in their bed and heard a noise downstairs, he took his pistol to investigate and sure enough, two people had broken in. He could see their dark shapes in the living room and fired, killing one. It turned out to be two teens with the intent on burglarizing the home. They were unarmed.
Because they were unarmed, but committing a crime, he received eight years.
Personally, I feel he should have been given an award for getting rid of some scum.
Also, some victims families also have a right to their input on the penalty and convince some prosecutors for lessor sentences.
Nothing is cut and dried, black and white. There are often extenuating circumstances and they must be considered.
However, if you are hyped up over the death penalty and want it, no matter what, move to North Korea. It's easy to get the death penalty there.
