You have: Involuntary manslaughter, voluntary manslaughter, 2nd degree murder and 1st degree murder. As most so-called murders fall into the first two categories, the sentences tend to be lighter (drunk driving accidents, careless/negligent behavior that results in death, et cetera). Thus, while someone died as the result of some stupid action(s), the sentence given is to teach a lesson, as well as punish, not put them away for the rest of their lives.

Regardless of the categories, the punishment must fit the crime. Due to the unrighteous judges being in a multitude these days, it seems that the reading of the laws in respect to the crimes are being manipulated by these judges.

A good example of a justified light sentence, my nephew. He and his wife were asleep in their bed and heard a noise downstairs, he took his pistol to investigate and sure enough, two people had broken in. He could see their dark shapes in the living room and fired, killing one. It turned out to be two teens with the intent on burglarizing the home. They were unarmed.
Because they were unarmed, but committing a crime, he received eight years.
Personally, I feel he should have been given an award for getting rid of some scum.
Also, some victims families also have a right to their input on the penalty and convince some prosecutors for lessor sentences.
Nothing is cut and dried, black and white. There are often extenuating circumstances and they must be considered.
However, if you are hyped up over the death penalty and want it, no matter what, move to North Korea. It's easy to get the death penalty there.
