The judge in Donald Trump’s Mar-a-Lago records case on Thursday denied a motion to dismiss from the former President that had little chance of succeeding, but set the case up for further delay.

Denying that motion — which held that the Presidential Records Act somehow allowed Trump to hold onto reams of classified documents at Mar-a-Lago — was the straightforward part. But U.S. District Judge Aileen Cannon for the Southern District of Florida made two other decisions in the brief, three-page ruling: she denied a motion from the special counsel for a ruling on competing sets of jury instructions she had requested, and she left the door open to revisit the issue during or after trial.

The decisions come after Special Counsel Jack Smith demanded rulings from Cannon on Trump’s motion to dismiss and on the jury instructions in a fiery, late-night Tuesday court filing.

You stupid twit. Notice that she did not rule that the Presidential Records Act does not apply - only that there is NO PROVISION for a pre trial dismissal.

Trump can re file this dismissal once the trial takes place - in the future. Once the motion is filed it will take several weeks at minimum to rule and even if she does not dismiss, Trump will have the right to appeal .

This case is not going to go to trial for a long time, almost certainly after the election and Trump will win on the end.

Seeing as Cannon has managed to leave the door open for the jury to consider evidence of Trump's innocence based on the PRA, a civil statute with no application to this case, it leaves Smith no choice but to force her to declare whether she thinks it does have application before the trial begins. A request he has already made and one which she denied. Then he can make a determination as to whether he should appeal to the 11th circuit to once again have her error reversed.

Matters such as these have never come up when it comes to the overt incompetence of federal judges until Trump. Just one more way he has damaged the country.
