It's not quite true that an employee can be terminated for ANY reason. Even though generally speaking certain employees may be fired for ”good reason, bad reason or no reason at all” the employer cannot fire someone for an ILLEGAL reason such as prohibited discrimination. According to the article, the woman's employer fired her because, “Basically, you cannot have lewd or obscene things in your social media.” However, the woman said “another employee had written a profane insult about someone on Facebook, but had been allowed to keep his job after deleting the post and being reprimanded.”

There are a lot of things to consider here, but there is at least the possibility of filing a discrimination complaint based upon sex. The woman would allege that her and the male employee were similarly situated and she was treated disparately because of her sex. The employer must than articulate a valid non-discriminatory reason for treating the woman differently. If the employer cannot meet its burden, the woman would be rehired with full back pay.

For all you union people out there, the same thing applies to probationary employees. Although they have no right to appeal their terminations through the negotiated grievance procedure, they do have the right to appeal to the Equal Employment Opportunity Commission (EEOC) if they believe their terminations were based upon a prohibited discriminatory factor such as race, religion, sex and so forth.

It is important to note that anyone can represent a complainant before the EEOC. You do not have to be a lawyer.
