WASHINGTON (AP) — The Supreme Court on Wednesday reinstated for now a Trump-era rule that had curtailed the power of states and Native American tribes to block pipelines and other energy projects that can pollute rivers, streams and other waterways.


So much for the GOP being the party of states' rights.

The Trump-era rule removed the power of the states and the SCOTUS let it stand for now until the rule is rewritten.

The SCOTUS ruling is correct as the judge did not have the power to stop it.

Too bad we do not have a party that actually believes in the idea of states' rights.

If the pipeline crosses State borders it becomes a federal issue.

If the pipeline stayed in the State in question, the rule would become overreach.

The GOP is only for states rights and small government when the states are doing things they agree with. They love big government when they can use it to force their ideals on everyone else.

The GOP is only for states rights and small government when the states are doing things they agree with. They love big government when they can use it to force their ideals on everyone else.

How is overturning Roe "Big Government"?
 
I would say that in general the GOP is more for state's rights than the democrats are, because the democrats want a larger and more controlling federal gov't than the republicans do. The issue here is not the SCOTUS ruling, but the rule itself.

The Trump administration in 2020 curtailed that review power after complaints from Republicans in Congress and the fossil fuel industry that state officials had used the permitting process to stop new energy projects. The Trump administration said its actions would advance then-President Donald Trump’s goal to fast-track energy projects such as oil and natural gas pipelines.
States, Native American Tribes and environmental groups sued. Several mostly Republican-led states, a national trade association representing the oil and gas industry and others have intervened in the case to defend the Trump-era rule. The states involved in the case are: Arkansas, Louisiana, Mississippi, Missouri, Montana, West Virginia, Wyoming and Texas.


So, do you want less expensive gas or not? Do you want states, tribes, and the enviros to be able to stop federal energy projects? Should one state be able to do that to the detriment of others? Should state's rights exceed that of the federal gov't in all cases?

I personally don't care about abortion one way or another. However, having it outright illegal is just going to create a market for backroom abortion clinics, just like it did before, which was literally the main reason why SCOTUS chose to rule it as a right to begin with.

It would be far better to lesson the need for abortions rather than ban them. Educating people about safe sex, making it easier to get birth control, even promoting adoption as an alternative (espcially now that there are literally hundreds of thousands of gay married couples who want to adopt).

However, there are plenty of examples of republicans supporting big government. Bans on gay marriage are the best example.

Gay Marriage wasn't a thing at all until recently, and Obergfell was far greater big government than anything a State would do. Obergfell should have just forced States to recognize any valid marriage license from another State, just as they did before.

Banning any real restrictions didn't lead to the issue going away, it led to the issue becoming worse.
 
No "rule" should stand after the administration that created it is out of office. If you want something done you get a law passed. If you are unable to do that. you then you need to work harder to convince people you are right.
