Student Arrested After Wearing Gorilla Mask, Carrying Bananas at Black Lives Matter Protest

Ok, charges have been dropped. In my book this would classify as police doing a great job. Considering they made an arrest, justified or not, which diffused a situation that could have easily escalated into violence. Now the school will deal with the idiot student they way they see fit. This seems like a near best case scenario. Had the cops not intervened and people would have gotten violent their could be broken bones, people seriously hurt or even dead. And probably assault charges for some.
Still, false arrest is false arrest.

Police are not empowered to arbitrarily assert their authority and to forcefully impose on citizens because they believe it is prudent to do so. Their job is to enforce existing laws, not to dictate behavioral standards. A more proper exercise of their authority would have been to ensure that the fellow they arrested for free expression was not harmed by those with opposing ideas.

Racism is ingrained in our justice system. Black men are far more likely to be harassed, stopped, questioned, arrested for petty crimes that white people commit just as frequently. They are more likely to be convicted and put in prison for the same crimes as their white counterparts. They also seem to be getting killed by cops quite a lot, lately, for not good reasons.
I think this kid ought to get educated about that.
Actually, I changed my mind and decided the school should require him to do 20 hrs/week at an after school program at an inner city YMCA for a semester, instead.

(b) A person commits the offense of intimidating others from exercising civil rights who:

(2) Injures or threatens to injure or coerces another person with the intent to unlawfully intimidate another because that other exercised any right or privilege secured by the constitution or laws of the United States or the constitution or laws of the state of Tennessee;



(c) It is an offense for a person to wear a mask or disguise with the intent to violate subsection (b)

He also had a right to get his ass beat for it, and the police did him a favor and got him out of there before it turned into a Trump rally. Then they dropped the charges and sent him home. I think they went above and beyond for a total turd.

The decisions of the Supreme Court have consistently upheld the rights of citizens to engage in First Amendment activity, even when reprehensible to the sensibilities of the majority. The obligation of the police in this case was to maintain order to protect this student, not to arrest him. His civil rights were violated and I hope he gets a good attorney and sues.

It's not illegal, however in a civil suit Tom and John Metzger were ordered to pay $12.5 million under the vicarious liability. So while it is not illegal it isn't without liability.

If this becomes an argued legal contest the pivotal object will be the word intent. The prosecution will need to prove the defendant intended to intimidate anyone. Keeping mind this is one individual vs a large group of supposed adversaries the prosecution will need to show how wearing a theatrical mask would have prevented any group or assembly of individuals from exercising their civil rights.

The problem is unless this masked fellow can afford to hire an exceptionally sophisticated trial lawyer, or he can find one who is willing for one reason or other to undertake the case either pro-bono or on a potentially worthwhile contingency basis, the arguable elements of the issue will never be weighed by a jury.

True but it doesnt prevent a cop from arresting them. Cops are not supposed to be judge and jury. They just arrest those that break the law like he did in this case.

There really is no way to compare yelling fire in a crowded theater to wearing of a possibly offensive mask during a political demonstration, The former is a clear intention to incite a hazardous reaction, the latter is not.
