A New Jersey teenager claiming that her mother and father tossed her out of their home and cut her off financially is suing them for immediate support, current private-school fees and future college tuition. The parents, meanwhile, say that daughter Rachel Canning, 18, moved out voluntarily after refusing to abide by their rules.

“We love our child and miss her. This is terrible. It’s killing me and my wife,” Rachel's father, Sean Canning, a town administrator and retired police officer, tells the Daily Record. “We have a child we want home. We’re not Draconian and now we’re getting hauled into court. She’s demanding that we pay her bills but she doesn’t want to live at home, and she’s saying, ‘I don’t want to live under your rules.’” The rules, he notes, include reconsidering her relationship with a boyfriend who may be a bad influence, being respectful, and abiding by her curfew. Doesn't matter the bitch is 18 and on her own. She has no right to sue.
 
Unless they informed the HS they were transferring her to a public school, the parents may owe for costs through her graduation since they probably enrolled her there. Beyond that... I don't think the young woman has a chance of getting anything that is not volunteered from the parents.

I don't know what kind of contract the parents have with the school. Whether it is for the year or for the semester and what the conditions are for cancelling

It seems the parents would have to notify the school that they were withdrawing her and that they would no longer be responsible for her bills

They don't owe anything beyond the year they contracted for. If she is 18, she's probably a senior and will graduate in June. They will need to pay fees through the end of the year, that's all.
 
Sounds like a total bullshit suit. I don't know all the in's and out's of what is going on, but don't see how the girl can sue her parents for her own support.

I can understand not wanting to live with mom and dad because their rules are unfair (or whatever she thinks) but can't understand how the parents are obligated to support their daughter after she left. Yeah, the parents are obligated to pay any outstanding bills from before she left, and I also agree with the parents offering to pay a college directly instead of giving their daughter cash.

But since my parents could barely keep my brothers and me clothed and fed, my view of the lawsuit is greatly prejudiced in favor of the parents.
 
18 years old? When I was 18 I was stationed on the Czech border and went to Lebanon on an military operation. I could have sued my parents and got out of that mess? Hindsight sux.

Wealthy people can be shitty parents too, people. The assumptions that it's the kid who's wrong in this instance, that the parents are all they say they are, is very telling.

How much money her parents have doesn't have a damn thing to do with whether or nor they have to spend it on her.
The idea that the amount of money the parents have makes a difference in whether or not she has a case worth listen to is even more telling.

If there is any abuse ... Then take it to the authorities and prosecute it as a criminal offense.
That is not what they are doing ... The girl and lawyers are suing for money ... Which is also very telling.

Have you ever heard of, or experienced the paperwork involved in attending college or university? There are very specific questions as to the PARENTS finances in figuring the availability of financial aid, loans, grants.

The kid got a $20,000 a year scholarship for christ sake - I'd say she worked pretty damned hard to get as far as she has, and that it's a shit sandwich that her rotten parents are trying to cut her off at the knees by holding her chances for a bright future over her head to control who she dates.

My bet is that he isn't the "correct" economic class, or color.

They should mediate and keep private conflicts from racking up public expense.

I question the lawyer charging money to sue, when mediation could be settled for less.
Heck, even hiring someone to do a fundraiser or put a grant together could help get
her loans or assistance to pay the costs herself instead of wasting thousands suing!

While the family works out their differences, if money could be lent into a neutral fund,
then after the issues are resolved, either the daughter can pay back the costs of her own education over time, or the parents might agree to cover part or all.
This could be worked out later, while the money is set aside so her education is not interrupted, and she can focus on school instead of stressing.

Still think they'd do better mediating, to save the relationships first as priceless and not worth ruining by lawsuits no matter how much money there would be to gain, and having a fundraiser to help an honor student pay for her own education instead of suing anyone.

Heck, I'd be willing to contribute to a fundraiser for this young lady to promote mediation to save money for education instead of wasting on litigation. and the value of saving relations.
Organize teams of neutral donors, like friends of the family, to chip into a student loan fund, agree on an interest rate or a business plan, and pay for her school until she can work to pay it back over time.
And this would teach the value of time, money, education, and mediating to save relationships from getting stressed out over money and personal conflicts that are temporary.

Seems like someone doesn't want to live by her parents rules. Too bad for her! Her parents don't have to pay for her to attend a private school (no law that I'm aware of) - there's plenty of public ones she can attend. They also aren't required to pay any of her living expenses since she decided to leave the house on her own. I really hope the judge does the right thing and lectures her before throwing this case out, with her having to pay her parents back for the expenses they incurred over this pile of crap.

My bet is that he isn't the "correct" economic class, or color.

Hi Barb that's fine if you disagree with the parents, but who is going to pay?

If people like the lawyer are willing to take responsibility that the parents' aren't, then sure they can criticize them if THEY would pay for this honor student to finish private high school.

If the student asks for help to borrow the money, and she'll work to pay it later,
that means SHE is taking responsibility herself, and can show she deserves the support -- of people who believe in giving her credit.

If the parents don't agree to extend this credit, I see no reason she couldn't ask others. If she is this precocious and independent, that should be marketed to get her some help.

Seriously, I think she and the lawyer could do better setting up a gofundme account or trying to get a loan from a bank or business. The lawsuit seems to do more for publicity than it does to solve the root problem, which will still remain even if the parents pay up.

OK so is the boyfriend willing to help pay for her school?
Are they willing to work to pay back the costs if they borrow money up front?

If they are willing to accept responsibility, why not support them in doing so?
This sounds like an ideal opportunity to teach a young couple financial independence
and the freedom that comes with it when you choose whom to borrow from.

PS if the parents had a contractual agreement with their daughter to pay for her tuition until she graduated that is one thing.
If not, if they only went day by day, year by year, with a verbal agreement and understanding to make decisions by consent;
then the minute they no longer consented, they didn't agree with her boyfriend while she is living under their roof,
and she didn't agree to drop him in order to get money to finish school, then they are both equally in conflict.

If you are saying the parents cannot force her not to see the young man when she is a consenting adult,
then it is fair to say she cannot force them to pay for her housing and school after 18 either.

If you say it is moral obligation for parents to pay for her until she is independent,
it can be argued it is moral obligation to obey parents if you live under their roof until you are independent.

The conflicts seem pretty mutual to me.

Given that it is a stage/process in development to go through these conflicts,
that is where I'd recommend setting up a loan fund, where the student agrees to pay it back
after they resolve all these other issues, and not let any delay or stress interfere with her school.

If the parents don't want to help lend, other people can be asked to help.
I think that would be educational and supportive of all sides so they can focus on resolving their relationship issues.

Rachel Canning declined comment. She is staying with her best friend's family - attorney and freeholder John Inglesino. He is funding the lawsuit, saying it's the only way the bright and focused teen will be able to go to a college appropriate for her to become a biomedical engineer. Rachel, who has a $20,000 scholarship, says the University of Vermont, a private college, is her first choice.

"We have a college fund available, but it is the equivalent of shopping at a high end and sending us the bill," Sean Canning said.

Rachel says she didn't run away but was given the option of dumping her boyfriend or getting out.

"Me and my wife are distraught," Sean Canning said.

Both sides will be in court on Tuesday. Rachel Canning wants the court not to emancipate her because under the law a parent has an obligation support their children if they can't stand on their own financially.

The parents also refuse to pay for the rest of her Catholic high school education.

"There privileges to living in my house... living under our roof," Sean Canning said.

Canning is a retired police chief who says like many other American households, his household has rules. But he says Rachel chose to leave home in a dispute over curfews and chores.

Rachel is now living in Rockaway, New Jersey. The court hearing Tuesday will be the first time Sean Canning will see his daughter since October of last year.

THEY promised her that if she worked hard in school they would help her go to a good college. THEY decided that they didn't like who she was dating and now want to dump her like yesterdays trash, and everyone here acts like SHE'S the asshole.
