Those two sentences do not mean the same thing.

One means Congress has to enforce it, the other means Congress doesn't have to enforce it.

As far as whether or not states can enforce it, YOU already supplied the answer to that when YOU pointed out states can't impeach a president because the Constitution declares the House shall have "SOLE" power to impeach; while the 14th Amendment does NOT include such a limitation.

I didn’t shift any meaning. Everything I said was the same thing. You are splitting hairs about the full wording, but in every statement, I meant the same thing, what I said meant the same thing. “Shall enforce” and “shall have the power to enforce” mean the exact same thing.

The word “sole” not being in the section 5 doesn’t change anything. There are many places where the word “sole” is not listed in the cotus. In that example, they are pointing specifically to the house, saying the house has the sole power to impeach, in section 5, it says “congress” must pass legislation. That could be either the house or senate or both.

You should really consider the word “shall”…it’s used a lot in the cotus, to declare powers that Congress must do, and to declare what rights are protected. Are you really going to say “shall” means “may”? That changes a lot of stuff in the cotus.


When it says “Congress shall have the power to enforce…” that is declaring a directive power and action. It is assigning responsibility to Congress…that what “shall” means.
