Aamof, they are encouraged to do so. We must remember that WHEN the constitution was written, MOST of the power of the Fed, was in that which was allowed by the states. The Fed was weaker. Even our wars were fought with armies made up up state militias hand in hand with a federal Army. Much Federal legislation passed were first passed by the states which then garnered support on the Federal level. The US Supreme Court should remember that and interpret amendment 14 sec 3, verbatim.

the feds issue suggested management procedures and the congress has authority to rule on congressional elections, but given that they haven’t, the states are left on their own Here. There is nothing in the guidelines that prevents it and congress after the fact can over rule them by a 2/3 majority…it’s all spelled out.
