In 1983, 241 American soldiers were murdered in a suicide bombing in Beruit, Lebanon. The survivors and family members of the deceased thereafter filed a civil suit in the US District Court for the District of Columbia against Iran. The action was known as Deborah D. Peterson vs. Islamic Republic of Iran. This is the Peterson case.
The case went to trial. In 2007, 24 yrs after the bombing, the court entered judgment against Iran and awarded damages in the total amount of $2.6 billion. Thus, the Peterson plaintiffs became judgment creditors of Iran. The court found that Iran provided funding and other material support to the terror group that performed the bombing.
Eventually, the plaintiffs, through their attorneys, located liquid assets in the amount of $1.75 billion in deposit accounts located inside the United States. The Plaintiffs took action to attach these funds to go toward satisfaction of the judgment. Obama ordered these funds frozen. Further, Congress passed, and Obama signed into law, the Iran Threat Reduction and Syria Human Rights Act of 2012 that, among other things, allows for the Peterson plaintiffs to levy on these deposits and any Iranian assets located in the USA.
Iran challenged the law and resisted the Peterson plaintiffs' attempt to levy. Eventually, the matter made its way to the US Supreme Court. In April 2016, in the case of Markazi vs. Peterson, the Supreme Court held that these Iranian assets could, in fact, be lawfully levied upon and used to go toward satisfaction of the Peterson Judgment (Markazi is the name of the state owned bank of Iran). Justice Ginsberg wrote the opinion. As a result, the $1.75 billion was seized, and said funds are presently being disbursed pro-rata to the Peterson plaintiffs.
Of course, these funds will not satisfy the entire judgment. The Peterson plaintiffs may, or may not, ever recover another dime. Now, the rest of the story.
We all know about Obama's nuclear "deal" with Iran. Part of this "deal" resulted in Obama sending $400 million to Iran. Some called this payment ransom for getting some people released from Iranian custody. Others said that the money simply belonged to Iran and that they deserve it back. These funds were paid in cash, back around the first part of 2016, right before the Supreme Court was to make their ruling in the Markazi vs. Peterson case. This payment was not disclosed to the public until well after Markazi was decided. In fact, it was not made public until the end of the summer of 2016.
What does all this mean? It means that Obama chose to give Iran $400 million of its frozen funds instead of allowing the Peterson plaintiffs to get it to go toward paying the judgment. That is, Obama took money out of the hands of victims of Iranian funded terrorism and rewarded Iran, giving the money to them instead.
The implication is quite clear: Obama chose Iran over the victims of Iranian terrorism.
What's more, it is clear from the timing of all of this that Iran wanted that money in the event the Supreme Court decided the Markazi case in a manner adverse to Iran. In other words, Iran wanted those frozen funds before the Peterson plaintiffs got to it. Obama gave it to them. Obama assisted Iran in evading the Peterson judgment creditors, because shortly after Obama's clandestine payment to Iran of $400 million cash, the Supreme Court held that Peterson could levy on Iranian assets.
Why did Obama do this? He could of given the money to the victims of Iranian terror. But no, he gave it to the perpetrator of the victims' terror. Yes, it was Iran's money. But the deposits of the Markazi bank also belonged to Iran, and the Peterson plaintiffs got to that. Could the Peterson plaintiffs ever levied against the $400 million frozen funds? We will never know. One thing is for certain: Obama could have turned over the funds to the Peterson plaintiffs. There is NOTHING preventing him from doing so. But instead he used the frozen $400 million to buy the Iranian nuke deal. Was it worth it??
Releasing that $400 million to Iran instead of the Peterson plaintiffs is one of the darkest, most cynical and anti-American things that Obama did, or even could have done. It is not even well-known outside of the families and a small group of people familiar with the case. Moreover, the Peterson case is direct evidence supporting the conclusion that Obama is NOT on America's side. He may of been born in this nation, but he is NOT an American.
