judge Engoron allowing trump speak in court is widely reported, but only trump speaking outside court is televised.

Trump habitually exaggerated his wealth on financial statements, deceiving a bank and insurance companies into giving him plum deals. This is not a criminal matter, but instead only a civil matter that is resolved with a fine. Its a violation of civil law to inflate wealth to get better deals.
 
Show me where the banks did that for all his properties and I'll consider your claim.

It's irrelevant. The law was created because the banks are corrupt also.

To say no one was harmed would be like going into court after getting charged with a DUI even though no one got hurt and arguing that.

The form document declaring the value of Trump's property assets that banks require for very large multi million dollar loans, was submitted by Trump's Accounting firm and CERTIFIED to be TRUE, ACCURATE.

Banks take the CERTIFIED document by the licenced Accounting firm, to be accurate, and use it.
 
They don't allow jury trials for that type of basically unConstitutional case.



You may find this interesting as the historical precedent, confirmed as Constitutional by the SCOTUS, is that the 7th Amendment applies to federal courts. Case citing are in the link. The second link is one of cases which forms the basis.

Then there is the difference between "common law" cases and "cases in equity" which are statutory cases and not common law.

False analogy. A DUI is a crime. DUI defendants are arraigned and charged with the crime, and they are entitled to put up a defense and receive a trial by jury. There are affirmative defenses for DUI, and the State has a burden to prove "beyond a reasonable doubt" that a defendant willfully committed the crime.

A dui is a misdemeanor in most states, unless a repeated offender, or you harm someone while DUI, then it is a Felony criminal offense.

Granted, this is a civil fraud case and not a felonious fraud case, or a misdemeanor fraud case if that even exists that could imprison you with punushment....

But the example given, still makes sense as an example, to me....

The AG and this judge have turned the statute into a Bill of Attainder, and that is repugnant to the rule of law.

"civil fraud" is a made-up quasi-crime.

Fraud is fraud. Whether it is penalized as a crime or a civil tort would be determined by the type of fraud. In all cases of fraud, there has to be some kind of scienter or negligence. Both types of fraud require a victim in order to bring the complaint.

Well then false analogies are valid arguments to you.

There are many crimes that have no victims- "attempted" anything is a crime with no victim, because something interfered with the commission of the act. Hiring a hitman to kill your spouse is illegal whether he succeeds or not...
