Like most on the right, Trump doesn’t know what he’s talking about.

But the Florida measure does afford due process before any firearms must be surrendered: only a judge may authorize the risk-protection petition pursuant to a hearing where the respondent has the right to enter evidence in opposition to the petition.

The risk-protection petition cannot exceed a 12-month period; the respondent has the right to request a hearing to have the petition vacated, and when the risk-protection order is vacated or ends absent extension, the respondent’s firearms are returned to him.

Again, it is a lie on the part of conservatives to claim that in Florida firearms are being ‘confiscated,’ there is no ‘slippery slope’ because comprehensive due process is afforded to the respondent, where only a court may authorize firearms be temporarily surrendered.
