President Donald Trump casually threatened to end the career of a Texas state senator who proposed limits to the state’s laws on asset forfeiture.

Trump met Tuesday morning with sheriffs from around the U.S., including one from Rockwall County, Texas, who told the president about a state lawmaker who had proposed asset forfeiture legislation that he believed would help Mexican drug cartels.

“Who is the state senator? Do you want to give his name?” Trump said. “We’ll destroy his career.”

The law enforcement officials laughed at the president’s remark, although Trump didn’t join them.

Sheriff Harold Eavenson declined to tell the president the name of the state senator who had irked him.

If it were used for "drug lords", you'd have something resembling a point.

What it gets used for is taking a teenager's car who had a bag of weed, and never returning it.

You might want to reread the article. The issue at hand is a Texas State Senator proposing a "FORFEITURE CAP" the asset forfeiture of Drug Lords.

The "FORFEITURE CAP" would not come into play with regards to a teenager's car who was caught with a bag of weed.

Please specifically explain how capping the dollar amount of what can be seized from DRUG CARTEL KINGPINS will affect a teenager and their car if they are caught with a bag of weed.

A bill prefiled in the Texas Senate for the 2017 legislative session would reform the state’s asset forfeiture laws to prohibit the state from taking property without a criminal conviction in most cases. The legislation also takes on federal forfeiture programs by banning prosecutors from circumventing state laws by passing cases off to the feds in most situations.


Sen. Konni Burton (R-Fort Worth) prefiled Senate Bill 380 (SB380) on Dec. 20. The legislation would reform Texas law by requiring a criminal conviction before prosecutors could proceed with asset forfeiture.


Under the current law, you are guilty until proven innocent. The cops steal your shit, and then you have to prove you came by it legally.

They like to pull over out of staters who they know will have great difficulty coming back to Texas and going through the court system to get their property back.

You don't understand how asset forfeiture works, do you. No true constitutional conservative would ever support our current civil asset forfeiture laws, but as I've pointed out many times, so-called constitutional conservatives are really controlling authoritarians who love a strong police state.
 
Most of us would be outraged by the idea that any government authority could take a person’s freedom or property without evidence or due process. That would be contrary to the most basic definitions of liberty that we Texans hold so dear. But this happens all the time in Texas, thanks to a pernicious practice called civil asset forfeiture. Law enforcement can legally seize private property if it merely suspects that the property was somehow used in a crime.
