Hur didn’t state what you claim. He never said he was guilty, that’s not his ability to determine. He said there was evidence against him but it was not likely going to prove beyond a reasonable doubt to a jury.

Trump never would have been in this position if he had turned the documents over when he received a subpoena for them. He’d have turned them over and the DoJ would be able to prove that he willfully retained them. The decision for Trump to lie and hide documents from the DoJ is why he’s in trouble. Being found incompetent to stand trial would be a clinical and legal determination by a judge that Biden couldn’t literally not understand the charges or process.
