Actually, they weren't.
Abortion laws were routinely being disregarded by women and their doctors before Roe. The problem with the abortion laws is that they were not being enforced. The courts really didn't think that they were doing anything more controversial than when they overturned the laws against contraception in Griswold v. Connecticut. These things were on the books, but nobody was following them.
Kind of like prostitution laws now. Yup, prostitution is illegal, but there are a bunch of strip joints, massage parlors, escort services, etc. where you can exchange sex for money.
As for Gay marriage, the problem there is that we've already established marriage as a right.
