New York judge rules Trump committed fraud while building real estate empire​

The ruling comes after New York Attorney General Letitia James accused Trump of overvaluing his assets​

A New York State Appeals Court rejected former President Donald Trump’s request to delay a civil trial stemming from New York Attorney General Letitia James’ investigation into his businesses, scheduling the beginning of the trial for early next week.

The non-jury trial, presided over by Judge Arthur Engoron, will begin Monday in Manhattan. The former president and 2024 GOP frontrunner is listed among dozens of possible witnesses.

Engoron on Tuesday ruled that Trump and the Trump Organization committed fraud while building his real estate empire by deceiving banks, insurers and others by overvaluing his assets and exaggerating his net worth on paperwork used in making deals and securing financing.

Engoron’s ruling comes after James sued Trump, his children and the Trump Organization, alleging that Trump "inflated his net worth by billions of dollars" and said his children helped him to do so.

"At the end of Monday’s court session, Judge Arthur Engoron responded to testimony from former Mazars account Donald Bender about the 2011 financial documents, acknowledging that a state appellate court had ruled the statute of limitations only allowed allegations from 2014 onward to apply in the case.

“I trust that you can relate the 2011 documents to something that happened later,” Engoron said to the attorney general's lawyers. “Or this has all been a waste of time.”
The defense agreed with Engoron's assertion, prompting Trump to give a thumbs up.

The judge’s comment marked a small win for Trump because it showed the judge again recognizing the statute of limitations that had been decided by the appeals court.

At the same time, however, Engoron did allow the witness testimony about the 2011 financial documents on Monday over the objection of Trump’s attorneys, as the attorney general's office indicated it would connect the testimony to allegations that fall within the statute of limitations.

Bender is returning for a second day of testimony on Tuesday.

He most certainly used the 18 million dollar tax appraisal as a basis for his decision. That in itself should be considered fraudulent.

between $ 18 million and $ 27.6 million. NYSCEF No.905

Notwithstanding, the SFCs values do not reflect these land use restrictions. Donald Trump's
for 2011-2021 value Mar- a - Lago at between $ 426,529,614 million and $ 612,110,496, an
overvaluation of at least 2,300% , compared to the assessor's appraisal.

He then goes on to dismiss Lawrence Moens', a real estate broker in Palm Beach, claim that the property could be sold for as much as 1.51 billion.

It sure does seem like he was assuming the value was between 18 and 27.6 million since he never stated otherwise and dismissed Moens' assessment. Why else would he mention the tax value unless he found it to be relevant? He also calculates the overvaluation by using these numbers. Weird huh? I might also add that this guy is a complete idiot when he states that the "Palm Beach County Assessor appraised the market value..." County assessors don't appraise market value. That is a profoundly ignorant statement.
