It was the majority in the appeals court wasn't it? The FDR administration denied asylum to a whole ship load of Jewish refugees who were fleeing the Nazis.
 
How would this "disqualify" her? Appellant judges are supposed to rule on the law, not on their "gut feelings". They aren't legislators.

If Congress wants to admit MS 13 as refugees, they will pass a statute.
Very true, and just one judge of the majority that denied him. There is more to this story
than just what this article is stating.
